<br /> <br />collectively refer to the Initial Major Improvement PID Bonds and any Additional Major <br />Improvement PID Bonds throughout this 2018 SAP. <br /> <br />“Non-Benefited Property” means Parcels within the boundaries of the Property that accrue <br />no special benefit from the Public Improvements, including Owner’s Association Property, <br />Public Property and easements that create an exclusive use for a public utility provider. <br />Property identified as Non-Benefited Property at the time the Special Assessments (i) are <br />imposed or (ii) are reallocated pursuant to a subdivision of a Parcel is not assessed. Assessed <br />Property converted to Non-Benefited Property, if the Special Assessments may not be <br />reallocated pursuant to Section VI.C or Section VI.D, remains subject to the Special <br />Assessments and requires the Special Assessments to be prepaid as provided for in Section <br />VI.E. <br /> <br />“Owner’s Association” means a homeowner’s association or property owner’s association. <br /> <br />“Owner’s Association Property” means property within the boundaries of the PID that is <br />owned by or irrevocably offered for dedication to, whether in fee simple or through an <br />exclusive use easement, an Owners’ Association established for the benefit of a group of <br />homeowners or property owners within the PID. <br /> <br />“Parcel” means a property identified by either a tax map identification number assigned by <br />the Hays County Appraisal District for real property tax purposes, by metes and bounds <br />description, by lot and block number in a final subdivision plat recorded in the official public <br />records of the County, or by any other means determined by the City. <br />“PID” means the Trace Public Improvement District created by the City pursuant to <br />Resolution No. 2015-145R approved on October 20, 2015. <br /> <br />“PID Act” means Chapter 372 of the Texas Local Government Code, as amended. <br /> <br />“PID Financing Agreement” means that certain financing agreement between the <br />Highpointe Trace, LLC and the City approved by Resolution No. 2015-146R on October 20, <br />2015, as amended. <br /> <br />“Prepayment Costs” mean interest and expenses to the date of prepayment, plus any <br />additional expenses related to the prepayment, reasonably expected to be incurred by or <br />imposed upon the City as a result of any prepayment of a Special Assessment and the Major <br />Improvement PID Bonds secured by such Special Assessment. <br /> <br />“Property” means the approximately 417.63 acres of property depicted and described by <br />metes and bounds on Exhibit A to Resolution No. 2015-146R as adopted by City Council on <br />October 29, 2015 of which 320.28 acres are developable and are to be assessed with a Special <br />Assessment. The Property is located within the City and is legally described in Appendix B <br />to this 2018 SAP and is depicted in Table II.A of this 2018 SAP. <br /> <br />6 <br /> <br /> <br />
