RESOLUTION NO. 2018-134R <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br /> MARCOS, TEXAS AUTHORIZING THE SUBMISSION OF A TEXAS <br /> HOME INVESTMENT PARTNERSHIPS PROGRAM APPLICATION TO <br /> THE TEXAS DEPARTMENT OF HOUSING AND COMMUNITY <br /> AFFAIRS FOR THE HOMEOWNER REHABILITATION ASSISTANCE <br /> ACTIVITY PROGRAM; AND AUTHORIZING THE CITY MANAGER <br /> TO ACT AS THE CITY'S EXECUTIVE OFFICER AND AUTHORIZED <br /> REPRESENTATIVE IN ALL MATTERS PERTAINING TO THE CITY'S <br /> PARTICIPATION IN THE HOME PROGRAM; AND DECLARING AN <br /> EFFECTIVE DATE. <br /> RECITALS: <br /> 1. The City Council of the City of San Marcos desires to develop a viable <br /> community, including decent housing and a suitable living environment and expanding economic <br /> opportunities, principally for persons of low/moderate income. <br /> 2. Certain housing conditions exist in the City of San Marcos ("City") which <br /> represent a threat to the public health and safety of City residents. <br /> 3. It is necessary and in the best interest of the City to apply for participation in the <br /> HOME program. <br /> BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br /> TEXAS: <br /> PART 1. A request to the Home Investment Partnerships Program for participation <br /> in the HOME Program is authorized to be filed on behalf of the City with the Texas Department <br /> of Housing and Community Affairs for Homeowner Rehabilitation Assistance activity. <br /> PART 2. The City has $40,000 in cash reserves to meet and exceed the requirements <br /> of the program during the contract term. <br /> PART 3. The City is committing to matching funds in the amount of $72,353 <br /> consisting of waived fees, in-kind services, and cash as a contribution toward the activities of the <br /> HOME program for households. <br /> PART 4. The City Council directs and designates the City Manager Bert Lumbreras <br /> as the City's Chief Executive Officer and as the authorized representative to represent the City in <br /> all matters pertaining to the City's participation in the HOME Program. <br /> PART 5. The City agrees to enforce its Affirmative Fair Housing Marketing Plan. <br /> PART 6. This Resolution shall be in full force and effect immediately from and <br /> after its passage. <br /> ADOPTED on August 7, 2018. <br />
