ASSESSMENT AND COLLECTION AGREEMENT <br />STATE OF TEXAS <br />COUNTY OF HAYS <br />This contract is between Hays County, hereinafter called "County", and the City of San Marcos, <br />Texas, acting as the Trace Public Improvement District Board of Directors, hereinafter called "District", <br />and is entered into on this the 1 st day of October, 2018, under the provisions of Chapter 791 Government <br />Code, V.T.C.S. and Chapter 6, Property Tax code. <br />I. PURPOSE <br />The parties to the contract wish to consolidate the assessment and collection of property taxes and <br />special assessments, hereinafter called "Assessments", into one entity, Hays County, under the provisions <br />of Section 6.24 of the Property Tax Code. <br />II. TERM <br />This contract shall be effective from October 1, 2018 through September 30, 2019, and thereafter <br />for yearly terms commencing on October 1 of each year and ending on September 30 of the succeeding <br />year, until terminated by one or more of the parties pursuant to the termination provisions of this contract. <br />III. APPOINTMENT OF TAX ASSESSOR -COLLECTOR <br />The Tax Assessor -Collector of Hays County is hereby designated as Tax Assessor -Collector for <br />the District. The District authorizes the County to make all decisions regarding collection of assessments <br />that would otherwise be made by the District in the absence of this contract. <br />IV. SERVICES TO BE PERFORMED <br />County agrees to perform all necessary assessment and collection functions authorized by law for <br />the District. The functions shall include: <br />a. Receive current and delinquent assessment roll from the District on or before September <br />15 of each year. <br />b. Mailing of current and all required delinquent assessment statements, which may be <br />combined with property tax statements. <br />C. Proration of assessment bills as required. <br />d. Correction of assessment bills as required. <br />e. Preparation of assessment receipts, which may be combined with property tax receipts. <br />f. Collection of current and delinquent assessments. <br />g. Issuance of assessment refunds as required. <br />V. ASSESSMENT AND COLLEC'T'ION RECORDS <br />The District's initial assessment levy shall be for the year 2017. To date, no prior assessment <br />records exist. At the termination of this Contract for any reason, County shall return copies of all <br />assessment and collection records it holds concerning the District within fifteen (15) days after receipt of <br />notice of termination of this contract as provided herein below <br />VI. DELINQUENT ASSESSMENTS / EMPLOYMENT OF COUNSEL AND AUTHORIZATION <br />TO INSTITUTE LEGAL ACTIONS. <br />A. Pursuant to Section 6.24 of the Texas Property Tax Code, the District hereby authorizes the <br />County by and through the County's Tax Assessor -Collector to collect delinquent assessments <br />130 <br />
