As such, the City has a <br />special right of access to information related to the Company's performance under the Chapter 380 <br />Agreement. Certain information of the Company may be subject to disclosure under the Texas Public <br />Information Act. While the City may notify the Company of certain requests for information from third <br />parties, the City shall have no obligation to assert exceptions to disclosure of such information to the <br />Texas Attorney General or other authority having jurisdiction on behalf of the Company. <br />
