<br />107 <br />Regular Meeting January 26; 1998 Page 6 <br />AGREEMENT BETWEEN THE CITY AND BEATY SAUNDERS ARCHITECTS; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THIS AMENDMENT ON <br />BEHALF OF THE CITY AND DECLARING AN EFFECTIVE DATE. <br />Mayor Moore introduced for consideration Item 11.c.(11), adoption of a Resolution, removed <br />from the consent agenda, the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AMENDMENT NO.1 <br />TO THE AGREEMENT BETWEEN THE CITY AND GUADALUPE-BLANCO <br />RIVER AUTHORITY FOR THE SAN MARCOS REGIONAL WATER SUPPLY <br />PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE THE <br />AMENDMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br />Mr. Hernandez moved for adoption of the Resolution and Mr. Mihalkanin seconded the motion, <br />which passed unanimously. (Mr. Guerra present at 8:35 p.m. to vote on this item). <br />Mayor Moore introduced the City Manager's Report. Mr. Gilley had no report at this meeting. <br />Ms. Hughson asked when the new Police Chief would officially begin. Mr. Gilley stated <br />February 23, 1998. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor had no report at this meeting. <br />Mayor Moore introduced the City Council's Report. (1) Mr. Cox stated there was a community <br />clean-up day on Saturday; however, they ran out of volunteers. Mr. Hernandez stated the <br />clean-up looked good but several places were missed. (2) Mayor Moore stated on February 3, <br />1998, at 7:00 p.m. at the Library, the City would be co-sponsoring the Housing Financial <br />Corporation for a housing forum with representatives from the state, county and city. (3) Mayor <br />Moore stated on May 1, 1998, at the University Coliseum, the Mayors of the Corridor are <br />sponsoring a public policy sub-hearing for elected officials related to education, transportation <br />and water for the region. (4) Mayor Moore stated on March 26-27, 1998, there would be a <br />legislative conference in New Braunfels and the speaker would be Kaye Bailey Hutchison. (5) <br />Mr. Cox stated at the bond rating trip in New York he invited Moody's and Standard & Poors to <br />attend the May 1, 1998, meeting for the Corridor Communities so they can participate in the <br />concerns of our region. <br />Mayor Moore introduced an Executive Session pursuant to the Government Code, Section <br />551.071, to discuss pending litigation (Morris vs. Keefer; Wastewater Reuse Permit Proceeding); <br />and Section 551.074, to discuss duties of a public officer (City Manager). Mr. Mihalkanin <br />moved to adjourn into Executive Session at 9: 14 p.m. and Mr. Hernandez seconded the motion, <br />which passed unanimously. <br />Mr. Mihalkanin moved to reconvene from Executive Session at 9:50 p.m. and Ms. Hughson <br />seconded the motion, which passed unanimously. <br />Mayor Moore introduced for consideration adoption of a Resolution, the caption which was read <br />as follows: <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF AN EMPLOYMENT <br />AGREEMENT BETWEEN THE CITY AND LARRY D. GILLEY FOR THE <br />POSITION OF CITY MANAGER; AUTHORIZING THE MAYOR TO EXECUTE THE <br />AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br />Mr. Mihalkanin moved for adoption of the Resolution and to amend Section 4.A. to read ". . . <br />and up to 60 days sick leave. . ." and Section 4.B. to read ". . . employee resigns following a <br />decision whether formal. . ." and Mr. Cox seconded the motion, which passed unanimously. <br />
