150 <br />Regular Meeting July 27, 1998 Page 2 <br />Mayor Moore stated the San Marcos, Martindale, Caldwell County, Hays County, <br />Guadalupe County Joint Airport Zoning Board needed no appointments. Mr. Taylor stated <br />that Board met on an as-needed basis only and there is no current need for them to meet <br />and suggested the Council await that need and then consider making appointments to the <br />Council's positions. <br />Mayor Moore introduced for consideration a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF <br />THE CITY BY REZONING A 2.975 ACRE TRACT OF PROPERTY <br />LOCATED AT 1511 RANCH ROAD 12, FROM "R-1" (SINGLE- <br />FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "MF-1" (MULTI- <br />FAMILY DISTRICT [LOW DENSITY]; INCLUDING PROCEDURAL <br />PROVISIONS; AND PROVIDING FOR PENALTIES. <br />Mayor Moore opened the public hearing and asked if anyone wished to speak. Ms. <br />Hughson stated she would be abstaining because her sister owns property within 200 feet <br />and had fled a protest. Mr. Don Hoffman stated he was an owner of property consisting <br />of two and a half acres to the southwest in that area and would suggest property remain <br />"R-1". Mr. Hoffman stated the Oak Heights Neighborhood would like to see that it remain <br />as low a density as possible. Mr. Hoffman stated the property fronts on Ranch Road 12 <br />and is one of the most dangerous spots in town. Ms. Betsy Robertson stated she and her <br />husband Todd Derkacz own the property in question and are not requesting any change <br />in the density. Mayor Moore asked about the three dwellings located on the property. <br />Mayor Moore stated the Staff notes these dwellings are non-conforming and asked if this <br />inconsistency was created through the master plan process. Ms. Robertson stated these <br />dwellings were there before the property was zoned. Ms. Robertson stated the current <br />land use map Sector 2 recommends Medium Density Residential for this property. Ms. <br />Robertson stated the problem with traffic would not affect Oak Heights because traffic <br />would go directly to Ranch Road 12. Mr. Todd Derkacz stated he was requesting their <br />property be given a zoning change from "R-1" to "MF-1 and was convinced it would be a <br />good change for the City and for themselves. Mr. Derkacz gave a brief history of the <br />zoning change before the Planning and Zoning Commission and the outcome of their <br />meetings with neighborhood representatives and Camille Phillips. Mr. Derkacz stated they <br />are only asking for low density and the request is consistent with past zoning changes. Mr. <br />Steve Blank, Sheila Torres-Blank, Phil Sladek, Beverly Sladek, Mike Occhialini, Virginia La <br />Grange, Carolyn Jennings and Barbara Jacobson voiced their support for the zoning <br />change. Mr. Jake Isaac stated he represented the Oak Heights Neighborhood Association <br />and was representing Camille Phillips. Mr..Issac stated Ms. Phillips is a very strong <br />supporter for co-housing and the other Oak Heights residents would like to see an <br />ordinance that encourages ownership, which MF-1 does not. They hope a Cluster Housing <br />Zoning Ordinance will be passed soon which would accomplish all or most of the things <br />that people are supporting. There were no other speakers so Mayor Moore closed the <br />public hearing. Mr. Taylor stated the City could initiate a zoning change assuming that the <br />change to MF-1 passes and development occurs in accordance with what would be a <br />Cluster Housing concept, and then the City would initiate a zoning change to fit the <br />development. Mr. Taylor stated the "MF-1" Cluster change if adopted would apply to all <br />property zoned in that classification in the future and all property of that nature that had <br />been developed in the old development would be non-conforming uses. Mr. Hernandez <br />moved for adoption of the Zoning Ordinance and Mr. Doiron seconded the motion. <br />Discussion ensued. Mr. Cox questioned if the number of objections from 1997 were still <br />valid. Mr. Taylor advised they are not valid and the current objections were not included <br />in the packet because they were the same names. The following vote was recorded: <br />AYE: Moseley, Cox, Hernandez, Mihalkanin, Doiron, Moore <br />NAY: None. <br />ABSTAIN: Hughson
