<br />49 <br />Regular Meeting March 16, 1998 Page 9 <br />Mayor Moore introduced for consideration Item 12.D.(l4), adoption of a Resolution, removed <br />from the consent agenda, the caption which was read as follows: <br />A RESOLUTION OF THE CITY COUNCil., OF THE CITY OF SAN MARCOS, <br />TEXAS, DESIGNATING THE JACKSON CHAPEL ADDITION AS A <br />NEIGHBORHOOD PRESERV ATIONIREDEVELOPMENT AREA UNDER THE <br />TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS LOW <br />INCOME HOUSING TAX CREDIT PROGRAM; AND DECLARING AN EFFECTIVE <br />DATE. <br />Mr. Hart stated although he did not have any financial interest in this item, he would be <br />abstaining from the discussion. Ms. Hughson moved for adoption of the Resolution and Mr. <br />Hernandez seconded the motion. On roll call the following vote was recorded: <br />AYE: Mihalkanin, Hughson, Moore, Cox, Hernandez. <br />NAY: None. <br />ABSTAIN: Hart. <br />(Mf. Guerra not present on roll call). <br />Mayor Moore introduced for consideration approval to change the Regular Meeting date of <br />Monday, May 25,1998 due to the Memorial Day Holiday. Ms. Hughson moved to change the <br />meeting date to May 18, 1998 and Mr. Hernandez seconded the motion, which passed <br />unanimously. (Mr. Hart not present on roll call). <br />Mayor Moore introduced the City Manager's Report. Mr. Gilley had no report at this meeting. <br />Mayor Moore introduced the City Attorney's Report. Mr. Taylor had no report at this meeting. <br />Mayor Moore introduced the City Council's Report. 1) Mr. Guerra asked about the study <br />regarding user fees. Mr. Gilley stated some of the proposed fees have been implemented through <br />adoption and some need further study. He stated he would bring the information to the Council <br />periodically. Mr. Gilley explained there are a variety of user fees including franchise, streets, <br />alleyways, right-of-ways and haulers. 2) Mayor Moore stated he attended the Corridor Council <br />Conference in France to study the French Rail System. He stated the Corridor Council would <br />hold a meeting on May I, 1998, in Strahan Coliseum to discuss the Conference in connection <br />with commuter rail from Austin to San Antonio with stops in San marcos and New Braunfels, as <br />well as education, workforce, water and other issues. 3) Ms. Hughson stated the Hays County <br />Infrastructure Committee was discussing a new road study being commissioned. She stated FM <br />110 loop around San Marcos was discussed and that it could potentially relieve traffic in many <br />areas of town. She stated the Committee needs the information by April 9, 1998. <br />Mayor Moore introduced for consideration an Executive Session pursuant to the Government <br />Code, Section 551.071, to discuss pending litigation (Boyd vs. DuMor Construction, Et AI) and <br />matters where the City Attorney's ethical duty to the City clearly conflicts with Government <br />Code, Chapter 551 (development incentive proposal- Springtown Center; utility service <br />extensions - IH-35 North and SH-123). Mr. Hernandez moved to adjourn into Executive Session <br />at 10:02 p.m. and Ms. Hughson seconded the motion, which passed unanimously. <br />Mr. Mihalkanin moved to reconvene from Executive Session at 11 :31 p.m. and Mr. Hernandez <br />seconded the motion, which passed unanimously. <br />The meeting adjourned at 11 :31 p.m. on motion made by Mr. Mihalkanin and seconded by Mr. <br />Hernandez. <br />
