92 <br />Regular Meeting March 23, 1998 Page 4 <br />AGREEMENT; AND DECLARING AN EFFECTIVE DATE. <br />(Mr. Mihalkanin, Ms. Hughson, Mayor Moore, and Mr. Hernandez filed an Affidavit of <br />Disclosure on the above item). <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE TERMS AND CONDITIONS OF A LICENSE <br />AGREEMENT BETWEEN THE CITY AND SOUTHWEST TEXAS STATE <br />UNIVERSITY FOR THE CONSTRUCTION AND MAINTENANCE OF A NON- <br />POTABLE WATER SUPPLY LINE UNDERNEATH SESSOM DRIVE; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />(Mr. Mihalkanin, Ms. Hughson, Mayor Moore, and Mr. Hernandez filed an Affidavit of <br />Disclosure on the above item). <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, APPROVING THE PURCHASE OF AN AUTOMOBILE FOR THE POLICE <br />DEPARTMENT CRIMINAL INVESTIGATION DIVISION THROUGH THE STATE <br />GENERAL SERVICES COMMISSION; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE PURCHASING DOCUMENTS WITH THE STATE ON BEHALF OF THE <br />CITY AND DECLARING AN EFFECTIVE DATE. <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS, AWARDING ANNUAL CONTRACTS FOR ANALYTICAL SERVICES FOR <br />THE WASTEWATER TREATMENT PLANT TO ANALYTICAL <br />ENVIRONMENTAL AND THE CITY OF AUSTIN; AUTHORIZING THE <br />PURCHASING MANAGER TO EXECUTE CONTRACT DOCUMENTS ON BEHALF <br />OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />Mayor Moore introduced a discussion regarding direction to negotiate with proponent in regard <br />to the Old Christian Church. Mr. Gilley explained the City held an RFP process for lease of the <br />Old Christian Church and Pastor Buntyn made an offer of $20,000 to purchase the property. He <br />explained the purchase would be over a twenty year period with renovations being done to the <br />Church; however, the RFP was for lease of the property which would eliminate the Abundant <br />Life's proposal of purchase. Mayor Moore stated the Senior Citizens Group proposed a thirty <br />year lease agreement, which was also not exactly what the RFP requested. Discussion ensued. <br />Mr. Guerra asked to hear from representatives of each proponent. Ron Jager, Chair of Sub- <br />Committee for the Senior Citizens, stated the committee met and drafted a proposal for the <br />Church. He said an addendum was circulated after that meeting stating in order for the <br />proponent to qualify, they must include youth and/or senior activities, which is the primary <br />purpose of the Senior Citizens organization. Mr. Jager stated he met with Pastor Buntyn last year <br />regarding the use of the facility and they agreed they wanted to accommodate each other's needs <br />in use of the building. Ms. Doris Colgin stated the Council voted not to sell the building which <br />was the purpose for the RFP process. Pastor Buntyn stated he thought the Council did not want <br />to deal with the building so their addendum was to purchase the building. He explained their <br />vision is to improve life of people and feels the building has life to do just that. He stated the <br />youth and the seniors can utilize the building; however, they simply would like to restore the <br />structure as a church which is how it started. Pastor Buntyn explained they felt they met the <br />demands of the lease agreement and the addendum was to express what they really wanted, <br />which is to purchase the building. Earl Moseley stated their first choice is to purchase the <br />building then to lease and asked if they had thirty days for negotiation. Mr. Guerra asked what <br />options the City had. Mr. Taylor explained the lease could only be with the Seniors group, but <br />the City could ask for a new RFP to lease or sell. Mr. Guerra requested the City reject both bids <br />and staff develop an RFP with clear direction. Mr. Gilley stated he felt the RFP was quite clear <br />and both proposals detailed a complete program; one a proposed lease and one a proposed <br />purchase. Mr. Cox stated he felt the Seniors met the criteria of the RFP and felt the City should <br />negotiate with them and if this does not work, then come back to the Council with a new <br />suggestion.
