WHEREAS, the City Council convened the hearing on October 1, 2018 at which all <br />persons who appeared, or requested to appear, in person or by their attorney, were given the <br />opportunity to contend for or contest the Amended and Restated Service and Assessment Plan, <br />the Additional Assessment Roll, and the Additional Assessments, and to offer testimony <br />pertinent to any issue presented on the amount of the Additional Assessment, the allocation of <br />Actual Costs, the purposes of the Additional Assessments, the special benefits of the Additional <br />Assessments, and the penalties and interest on annual installments and on delinquent annual <br />installments of the Additional Assessment; and <br />WHEREAS, at the October 1, 2018 public hearing referenced above, there were no <br />written objections or evidence submitted to the City Clerk in opposition to the Amended and <br />Restated Service and Assessment Plan, the allocation of Actual Costs, the Additional Assessment <br />Roll, or the levy of the Additional Assessments; and <br />WHEREAS, the City Council closed the hearing and, after considering all written and <br />documentary evidence presented at the hearing, including all written comments and statements <br />filed with the City, at a meeting held on October 16, 2018, approved and accepted the Amended <br />and Restated Service and Assessment Plan in conformity with the requirements of the PID Act <br />and adopted the Additional Assessment Ordinance, which approved the Additional Assessment <br />Roll and levied the Additional Assessments; and <br />WHEREAS, after approval of the Additional Assessments, the City Council determined <br />that collection of such Additional Assessments should be deferred until January of 2020 by <br />amending and restating the Additional Assessment Ordinance levying such Additional <br />Assessments after providing notices and holding the hearing required prior to original levy of <br />assessments; and <br />WHEREAS, the City Council published notice of a public hearing in a newspaper of <br />general circulation in the City on November 23, 2018 to consider the amended and restated <br />Additional Assessment Ordinance which included the proposed "Assessment Roll" and an <br />amended and restated service and assessment plan (as amended and supplemented, the "Service <br />and Assessment Plan") and the levy of the "Additional Assessments" on property in the District; <br />and <br />WHEREAS, the City Council mailed notice of the public hearing to consider the <br />proposed Assessment Roll and the Service and Assessment Plan and the levy of Additional <br />Assessments on property in the District to the last known address of the owners of the property <br />liable for the Additional Assessments; and <br />WHEREAS, the City Council convened the hearing on December 4, 2018 at which all <br />persons who appeared, or requested to appear, in person or by their attorney, were given the <br />opportunity to contend for or contest the Service and Assessment Plan, the Assessment Roll, and <br />the Additional Assessments, and to offer testimony pertinent to any issue presented on the <br />amount of the Additional Assessment, the allocation of Actual Costs, the purposes of the <br />Additional Assessments, the special benefits of the Additional Assessments, and the penalties <br />9 <br />
