Mayor Chiu stated the School District wouldfprovide a <br />name for consideration at the next meeting. <br /> <br />Mayor Chiu introduced for consideration a public hearing and adoption of a <br />Zoning Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 3.25 ACRE <br />TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH35 NORTH, FROM "R-1" <br />(SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "C" (COMMERCIAL <br />DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Jimmy Caldwell of Tilson Home Corporation stated he was present to answer <br />any questions. No one else wished to speak, so Mayor Chiu closed the <br />public hearing. Mr. Mayhew moved for adoption of the Zoning Ordinance and <br />Ms. Tatum seconded the motion. Ms. Hughson asked Mr. Theriot if there was <br />any concern regarding the triangular shape of the property. Mr. Theriot <br />stated the property behind this property is zoned Pre-Development <br />District, that this parcel is an existing parcel and the owner does not <br />own the adjoining property. The Council voted unanimously for adoption of <br />the Zoning Ordinance. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE ALLOWING CERTAIN EMPLOYEES OF THE CITY WHO HAVE <br />TERMINATED PREVIOUS MEMBERSHIPS IN THE TEXAS MUNICIPAL RETIREMENT <br />SYSTEM, TO DEPOSIT THE SUMS SO WITHDRAWN, PLUS ANNUAL WITHDRAWAL <br />CHARGES, AND ALLOWING AND UNDERTAKING THE COST OF ALLOWING ANY SUCH <br />EMPLOYEE CREDIT IN SUCH SYSTEM FOR ALL SERVICE TO WHICH SUCH EMPLOYEE <br />HAD BEEN ENTITLED AT DATE OF SUCH WITHDRAWAL, WITH LIKE EFFECT AS IF <br />ALL SUCH SERVICE HAD BEEN PERFORMED AS AN EMPLOYEE OF THIS CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Cox moved for approval of the Ordinance on first reading and Mr. <br />Mayhew seconded the motion, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration reconsideration of three Zoning <br />Ordinances. The Council did not wish to reconsider any of these <br />Ordinances. The captions of these Ordinances read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 9.03 ACRE <br />TRACT OF PROPERTY LOCATED AT 1414 PROSPECT STREET, FROM "ZL" (ZERO <br />LOT LINE DISTRICT) AND "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW <br />DENSITY]) TO "P" (PUBLIC AND INSTITUTIONAL DISTRICT); INCLUDING <br />PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br />
