13. Regular Meeting June 11, 2001 Page 2 Mayor Chiu introduced for consideration approval of one appointment to the Youth Commission. Mayor Chiu stated the School District wouldfprovide a name for consideration at the next meeting. Mayor Chiu introduced for consideration a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 3.25 ACRE TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH35 NORTH, FROM "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "C" (COMMERCIAL DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. Mayor Chiu opened the public hearing and asked if anyone wished to speak. Jimmy Caldwell of Tilson Home Corporation stated he was present to answer any questions. No one else wished to speak, so Mayor Chiu closed the public hearing. Mr. Mayhew moved for adoption of the Zoning Ordinance and Ms. Tatum seconded the motion. Ms. Hughson asked Mr. Theriot if there was any concern regarding the triangular shape of the property. Mr. Theriot stated the property behind this property is zoned Pre-Development District, that this parcel is an existing parcel and the owner does not own the adjoining property. The Council voted unanimously for adoption of the Zoning Ordinance. Mayor Chiu introduced for consideration approval of an Ordinance on first reading, the caption which was read as follows: AN ORDINANCE ALLOWING CERTAIN EMPLOYEES OF THE CITY WHO HAVE TERMINATED PREVIOUS MEMBERSHIPS IN THE TEXAS MUNICIPAL RETIREMENT SYSTEM, TO DEPOSIT THE SUMS SO WITHDRAWN, PLUS ANNUAL WITHDRAWAL CHARGES, AND ALLOWING AND UNDERTAKING THE COST OF ALLOWING ANY SUCH EMPLOYEE CREDIT IN SUCH SYSTEM FOR ALL SERVICE TO WHICH SUCH EMPLOYEE HAD BEEN ENTITLED AT DATE OF SUCH WITHDRAWAL, WITH LIKE EFFECT AS IF ALL SUCH SERVICE HAD BEEN PERFORMED AS AN EMPLOYEE OF THIS CITY; AND DECLARING AN EFFECTIVE DATE. Mr. Cox moved for approval of the Ordinance on first reading and Mr. Mayhew seconded the motion, which passed unanimously. Mayor Chiu introduced for consideration reconsideration of three Zoning Ordinances. The Council did not wish to reconsider any of these Ordinances. The captions of these Ordinances read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 9.03 ACRE TRACT OF PROPERTY LOCATED AT 1414 PROSPECT STREET, FROM "ZL" (ZERO LOT LINE DISTRICT) AND "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "P" (PUBLIC AND INSTITUTIONAL DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES.
