Developer or Future Owner executing the project an amount up to their pro rata <br />share of costs from any impact fees collected in relation to the Water Impact Fee <br />Project in compliance with Section 86.300 of the San Marcos City Code. The City <br />shall be responsible for acquiring all off-site easements or land associated with the <br />Water Impact Fee Project. However, the Developer, with the City's approval, may <br />acquire any required off-site easements or land, in which event the City will <br />reimburse the Developer for the cost of such acquisitions within 30 days of the <br />Developer presenting invoices to the City for the cost thereof. <br />2. Wastewater Impact Fee Project. <br />i. Design. Within 60 days after the City of San Marcos' Gary <br />Job Corps lift station has reached its maximum capacity, the Developer shall <br />have entered into a contract for the design of the Wastewater Impact Fee <br />Project. The final design and specifications are subject to approval by the <br />City in accordance with applicable ordinances and engineering standards of <br />the City. <br />ii. Construction. Within 360 days after receipt of final <br />approvals from all authorities having jurisdiction over the design of the lift <br />station and force main design(s) and acquisition of all necessary offsite <br />easements and rights-of-way for the construction of said lift station and <br />force main, the Developer shall commence construction of the lift station <br />and force main improvements in accordance with the plans and <br />specifications approved by the City.
