104. INTERLOCAL AGREEMENT FOR BROADCASTING SERVICES STATE OF TEXAS COUNTY OF HA YS The City of San Marcos (the "City") and Southwest Texas State University ("SWTSU") enter into this agreement under the authority of Texas Government Code, Chapter 791, as amended. The City agrees to: 1) Purchase and maintain equipment (the "Override Equipment") to be located at SWTSU's KTSW radio studio to allow the City to override transmissions on SWTSU's KTSW radio station from one or more remote locations determined by the City. Use the Override Equipment only in times of disaster or when emergency information needs to be disseminated to the general public. Allow only authorized emergency officials to access the Override Equipment. Be responsible for all expenses related to the Override Equipment, to be paid from current funds available to the City. 2) 3) 4) SWTSU agrees to: 1) Allow the City to install and maintain the Override Equipment at SWTSU's radio studio KTSW. Allow City emergency officials to use the Override Equipment to disseminate emergency or disaster-related information on KTSW. Retain the right to determine what constitutes an emergency and to determine whether to allow the City to interrupt regular programming to disseminate emergency information. 2) 3) This agreement will take effect immediately upon execution by both parties, and shall inure to the benefit and be binding upon the administrators, successors and assigns of the parties hereto. This agreement may be terminated by either party by giving 30 days advance written notice to the other party. Executed on July 10 , 2001.
