<br />179. <br /> <br />Regular Meeting <br /> <br />August 27, 2001 <br /> <br />Page 10 <br /> <br />EXECUTE THE AGREEMENTS ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Chiu introduced for consideration Item 17 removed from the consent <br />agenda, approval of an Ordinance on second reading, the caption which was <br />read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 2 OF THE CITY CODE TO CONVERT THE CEMETERY <br />COMMISSION, THE DRAINAGE ADVISORY BOARD AND THE SENIOR CITIZEN <br />ADVISORY BOARD TO STAFF ADVISORY BOARDS; MAKING OTHER CONFORMING <br />AMENDMENTS TO THE CITY CODE; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Hughson moved for approval of the Ordinance on second reading and Mr. <br />Mayhew seconded the motion. Ms. Hughson referenced Section 2.131(b), <br />which includes the executive director of the Community Action Program as <br />an ex-officio member. Ms. Hughson asked if there were other <br />representatives that should be included. Mr. Gilley stated he was not <br />sure if the executive director of Community Action participated on the <br />Senior Citizen Board, but there were no Staff recommendations to include <br />other representatives of agencies on this Board. Ms. Hughson stated if <br />this position is not participating, this should be removed from the <br />Ordinance. She requested Mr. Gilley determine this before third reading. <br />Mr. Gilley stated Staff would be prepared to provide a recommendation at <br />third reading. The Council voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Chiu introduced for consideration Item 20 removed from the consent <br />agenda, adoption of an Ordinance on third and final reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE GRANTING A PERMIT AND CONSENT TO EL PASO GAS <br />TRANSMISSION COMPANY, ITS WHOLLY OWNED SUBSIDIARY CORPORATIONS AND <br />WHOLLY OWNED SUBSIDIARY GENERAL AND LIMITED PARTNERSHIPS, AND THEIR <br />SUCCESSORS, LESSEES OR ASSIGNS, TO MAINTAIN, USE AND OPERATE EXISTING <br />NATURAL GAS AND/OR NATURAL GAS LIQUIDS TRANSMISSION PIPELINES ALONG, <br />ACROSS AND UNDER PUBLIC RIGHTS-OF-WAY IN THE CITY OF SAN MARCOS, <br />TEXAS; INCLUDING PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Ms. Tatum moved for approval of the Ordinance on third and final reading <br />and Mr. Mayhew seconded the motion. Mr. Taylor advised the Council the <br />questions asked of El Paso Gas Transmission Company could not be answered <br />quickly, and they requested this matter be tabled until the next regular <br />meeting. Mr. Mihalkanin stated he prefers the questions be answered in <br />writing. Mr. Mayhew asked Mr. Taylor to provide a brief background how we <br />carne to have this Ordinance. Ms. Hughson requested the Council discuss <br />this during tonight's Executive Session. The Council agreed to do so. <br />Mr. Taylor stated a group of cities in the valley has gas transmission <br />pipelines and the owners of the pipelines did not want to pay fees for use <br />
