<br />175. <br /> <br />Regular Meeting <br /> <br />August 27, 2001 <br /> <br />Page 6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE 2000-2001 CITY BUDGET TO PROVIDE FUNDING FOR THE SAN <br />MARCOS REGIONAL PARK PRESERVE PROJECT; AND DECLARING AN EMERGENCY. <br /> <br />Mr. Mayhew moved for adoption of the Ordinance on emergency and Ms. Tatum <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Chiu introduced for consideration approval of an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND RECYCLABLE MATERIALS; AND INCLUDING PROCEDURAL PROVISIONS. <br /> <br />Ms. Hughson moved for approval of the Ordinance on first reading and Mr. <br />Mayhew seconded the motion. Mr. Mayhew inquired when was the last <br />increase, and Ms. Hughson responded it was last year and this is an annual <br />item that is part of our contract. Mr. Mihalkanin stated he does not <br />receive good pickup service and has heard other complaints regarding the <br />service. Mr. Mihalkanin stated he does not feel BFI is taking care of <br />this contract. Ms. Hughson stated she has witnessed trash blowing from <br />trucks. She stated when this happens, the driver needs to stop the truck <br />and remedy this situation. Mr. Clement, of BFI, was present and noted <br />that both concerns would be addressed. Ms. Tatum asked Mr. Gilley to <br />explain the increase. Mr. Gilley stated the contract allows BFI to <br />request increases, and they must provide evidence of the need for the <br />increase, and they have done so. On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Hughson, Chiu, Cox, Mayhew, Tatum. <br /> <br />NAY: <br /> <br />Mihalkanin, Montoya. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Chiu introduced for consideration reconsideration of two Zoning <br />Ordinances. The Council did not wish to reconsider either of these <br />Ordinances. The captions read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 2 OF THE <br />RIVER PUB SUBDIVISION, LOCATED AT 302 RIVERSIDE DRIVE, FROM "C" <br />(COMMERCIAL DISTRICT) TO "R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW <br />DENSITY]); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 33.582 <br />ACRE TRACT OF PROPERTY LOCATED IN THE 2400 BLOCK OF IH35 NORTH, FROM <br />"R-1" (SINGLE-FAMILY DWELLING DISTRICT [LOW DENSITY]) AND "PD" (PRE- <br />
