Mr. Cox moved to elect Jane Hughson as Mayor Pro-Tempore and <br />Mr. Mihalkanin seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Montoya, Chiu, Cox, Mayhew, Tatum. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Hughson. <br /> <br />Ms. Hughson moved to appoint Joe B. Cox, Jr. as Deputy Mayor Pro-Tempore <br />and Mayor Chiu seconded the motion. On roll call the following vote was <br />recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Montoya, Hughson, Chiu, Mayhew, Tatum. <br /> <br />NAY: <br /> <br />None. <br /> <br />ABSTAIN: <br /> <br />Cox. <br /> <br />Mayor Chiu introduced for consideration remove from table and adoption of <br />an Ordinance on third and final reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE RELEASE OF CITY EASEMENTS LOCATED ON REAL PROPERTY <br />OWNED BY W. C. CARSON IN THE 100 BLOCK OF EAST CONCHO STREET; <br />AUTHORIZING THE CITY MANAGER TO EXECUTE A RELEASE AND QUITCLAIM DEED; <br />AND PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved to remove the Ordinance from the table and Mr. Mayhew <br />seconded the motion, which passed unanimously. Mr. Patterson reviewed <br />with Council information regarding this property. He stated the Zoning <br />Board of Adjustments and Appeals approved a variance regarding parking for <br />one space per resident. Ms. Tatum asked how the restriction on a maximum <br />of people is enforced, and Mr. Patterson stated there would be a condition <br />on the certificate of occupancy regarding the number allowed. Mr. Gilley <br />stated no one from Bonner-Carrington is present at this meeting, and Tom <br />Rodman, an attorney representing the Carsons, is present. Mr. Rodman <br />stated the easements in question have no value and do not serve property <br />other than that owned by the Carsons.
