• RESOLUTION 2009- 108R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY <br />OF SAN MARCOS, TEXAS APPROVING A SECOND <br />AMENDMENT TO THE CAPITAL IMPROVEMENT <br />AGREEMENT FOR SLC 61 JOINT VENTURE (THE <br />SECOND AMENDMENT) BY INCREASING THE CITY'S <br />COST PARTICPATION IN THE CONSTRUCTION OF <br />COTTONWOOD CREEK PARKWAY FROM $275,546.95 <br />TO $316,106.10; AUTHORIZING THE CITY MANAGER <br />TO EXECUTE THE SECOND AMENDMENT; AND <br />DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: <br />PART 1. The Second Amendment to the Capital Improvement Agreement for SLC 61 Joint <br />Venture (Second Amendment) attached to this Resolution as Exhibit "A" is hereby approved to <br />increase the City's cost participation in the construction of Cottonwood Creek Parkway between <br />Leah Avenue and Sadler Drive from $275,546.95 to $316,106.10. <br />PART 2. Rick Menchaca is authorized to sign the Second Amendment. <br />PART 3.
