Proposed 2019-2022 Meet and Confer Agreement <br />Between the San Marcos Police Officers' Association and the City of San Marcos, Texas <br />itself at arbitration, but the fees of the arbitrator shall be borne equally by the Parties. The written <br />decision of the arbitrator shall be final and binding on both Parties and may not be appealed by either <br />Party, except for any decision procured by fraud, collusion, or unlawful means, or which exceeds the <br />arbitrator's jurisdiction or which is based on legal conclusions or interpretations which are clearly contrary <br />to existing law. <br />Section 5. Mutual Extension <br />All deadlines within this article may be waived or extended by written mutual agreement by the Parties. <br />Failure to adhere to the time limit at Step 1 shall result in the matter being considered satisfied and no <br />further action shall be taken. If the last day of a time period herein falls on a Saturday, Sunday or City <br />holiday, the time period will be extended to the next business day. <br />PAGE 25 <br />
