RESOLUTION NO. 2019-157R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS AUTHORIZING THE CITY OF SAN MARCOS TO <br />FORM AN URBAN TRANSIT DISTRICT AS ALLOWED UNDER <br />CHAPTER 458, RURAL, AND URBAN TRANSIT DISTRICTS, OF THE <br />TEXAS TRANSPORTATION CODE; AND PROVIDING AN EFFECTIVE <br />DATE. <br />RECITALS: <br />1. The City is the principal municipality of the San Marcos urbanized area (UZA). <br />2. The City desires to provide needed public transportation services within the San <br />Marcos UZA. <br />3. The City is pursuing Direct Recipient designation to enable receipt of federal <br />Urbanized Area Formula Program assistance authorized by 49 U.S.C. 5307 for the San Marcos <br />UZA. <br />4. Direct Recipient status will enable the City to enter into contracts with the Federal <br />Transit Administration for the receipt and expenditure of federal funds in support of transit <br />operating, planning, and capital activity within the San Marcos urbanized area. <br />5. Chapter 458 of the Texas Transportation Code provides for the creation of urban <br />transit districts which provide federal and state supported transit services. <br />6. An Urban Transit District means a local governmental body or political subdivision <br />of the state that operates a public transportation system in an urbanized area with a population <br />greater than 50,000 but less than 200,000. <br />7. A transit provider can receive state or federal public transportation funds through <br />the Texas Department of Transportation only if the transit provider becomes an urban transit <br />district as provided in Chapter 458. <br />8. The City desires to form an urban transit district as described under Chapter 458 to <br />receive State Urban Transit Funds on behalf of the San Marcos UZA. <br />9. The boundaries of the San Marcos Urban Transit District will be those of the San <br />Marcos UZA as described in Exhibit A. <br />10. The San Marcos Urban Transit District will have no taxing authority without <br />legislative action and voter approval. <br />11. The San Marcos Urban Transit District will adopt by-laws describing the purpose, <br />jurisdiction, representation and terms, and meeting requirements. <br />
