Moore and City Council Members <br />From: Charter Review Commission <br />Subject: Report of the 1999-2000 Charter Review Commission <br />Date: January 11, 2000 <br />81. <br />The 1999-2000 Charter Review Commission has concluded its work after a series of ten meetings. <br />The Commission presents this report to the City Council with recommendations for amendments to <br />the City Charter to be submitted to City voters for approval. <br />Underlining indicates language proposed to be added, and overstrike indicates language proposed <br />to be deleted. The wording of each of the proposed changes is followed by a brief statement of the <br />Commission's rationale for the change. <br />1. Amend Sections 2.03 and 2.04 regarding annexations as follows: <br />Sec. 2.03. Extension or detachment of boundaries. <br />The city council shall have power by ordinance to fix the boundary limits of the City <br />of San Marcos and to provide for the alteration and extension of the said boundary limits, the <br />detachment of territory and the annexation of additional territory with or without the eonsent <br />of the territory mTd ini?itants annexed or detached, in accord with applicable state <br />annexation laws. <br />Sec. 2.04. Limited purpose annexation. <br />In addition to the power to annex additional territory for all purposes, the city shall <br />have the power, by ordinance, to fix, alter and extend the corporate boundary limits of the <br />city for the limited purposes of "planning and zoning" and "sanitation and health <br />protection," and to annex for one or both of such limited purposes additional territory lying <br />adjacent to the city with or without the consent of the property owners or inhabitants of suci <br />atmexed territory; provided, however, that no such territory which lies farther than one (f) <br />mile from the corporate boundary limits enclosing the territory which is a part of the city for <br />all purposes, as those corporate boundary limits are now or may hereafter be established, <br />shall be annexed for any limited purpose or purposes. Wherever the boundary limits of <br />territory annexed for one or both of such limited purposes are not coterminous with the <br />corporate boundary limits enclosing the territory which is a part of the city for all purposes, <br />such boundary limits of the limited purpose territory shall be known as "limited purpose <br />boundary limits".
