Moore and City Council Members <br />Page 9 <br />January 11, 1999 <br /> <br />Rationale: These changes are recommended to make the charter conform to State law and current <br />election practices. <br />10. Amend Sections 6.01 and 6.02 regarding initiative and referendum petitions as follows: <br />Sec. 6.01. Power of initiative. <br />The people of the city reserve the power of direct legislation by initiative, and in the <br />exercise of such power may propose any ordinance or repeal any ordinance not in conflict <br />with this Charter, the state Constitution, or the state laws. Any initiated ordinance may be <br />submitted to the council by a petition signed by at least ten {-1$j per cent of the qualified <br />voters of the city greater. <br />or two hmidred fifty (250), vviiiefierer is the Sec. 6.02. Power of referendum. <br /> <br />The people reserve the power to approve or reject at the polls any legislation enacted <br />by the council which is subject to the initiative process under this Charter. Prior to or within <br />thirty {36} days after the effective date of any ordinance which is subject to referendum, a <br />petition by at least ten"per cent of the qualified voters of the city <br />or tym hundred fifty <br />greater, <br />(250), whieliever is the may be filed with the city secretary requesting that any such <br />ordinance be either repealed or submitted to the vote of the people. When such a petition has <br />been certified as sufficient by the city secretary, the ordinance specified in the petition shall <br />not go into effect, or further action thereunder shall be suspended if it shall have gone into <br />effect, until and unless it is approved by the voters as herein provided. Notwithstanding the <br />foregoing, no zoning district boundary ordinance shall be subject to the referendum process. <br /> <br />Rationale: The 250 signature alternative for the minimum number of signatures is unnecessary since <br />the 10% figure yields a requirement, with current registered voter figures, of about 2000 signatures. <br />While seemingly high, this figure was met in the recent past with regard to the "medical marijuana" <br />initiative petition. <br />11. Amend Article VII regarding municipal planning and zoning as follows: <br />ARTICLE VII. MUNICIPAL PLANNING AND ZONING <br />Sec. 7.01. Planning and zoning commission. <br />(a) A city planning and zoning commission is established. Commission members <br />shall be appointed by the council and serve without compensation.
