RESOLUTION NO. 2019-183R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS APPROVING AMENDMENT NO. 1 TO THE <br />DESIGN -BUILD AGREEMENT BETWEEN THE CITY AND JE <br />DUNN CONSTRUCTION SETTING THE FINAL GUARANTEED <br />MAXIMUM PRICE FOR CONSTRUCTION PHASE SERVICES FOR <br />THE ADDITION AND RENOVATIONS TO THE SAN MARCOS <br />PUBLIC LIBRARY AT $12,100,000 FOR A TOTAL DESIGN -BUILD <br />AMOUNT OF $12,886,300; AUTHORIZING THE CITY MANAGER <br />OR HIS DESIGNEE TO EXECUTE THE AMENDMENT ON <br />BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />PART 1. The attached Amendment No. 1 to the Design -Build Agreement <br />("Agreement") between the City and JE Dunn Construction setting the final guaranteed <br />maximum price for construction phase services for the addition and renovations to the San <br />Marcos Public Library at $12,100,000 for a total Design -Build contract amount of <br />$12,886,300 is approved. <br />PART 2. The city manager or his designee is authorized to execute this Agreement <br />on behalf of the City. <br />PART 3.
