RESOLUTION NO. 2008 -23R A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS AUTHORIZING THE INTERIM CITY MANAGER TO EXECUTE A BUSINESS USE AGREEMENT WITH OFFICERS CLUB AEROVENTURES SAN MARCOS #2, LP AND BLUE SKIES AVIATION, LLC AND DECLARING AN EFFECTIVE DATE. RECITALS: 1. Officers Club AeroVentures San Marcos #1, LP is the Lessee of a hangar located at the San Marcos Municipal Airport under a lease approved by the San Marcos City Council on Apri119, 2005.. 2. On April 29, 2005 an Amendment Number 1 was approved for a ground lease and construction of a hangar and the operation of an aircraft hangar rental business; 3. On December 11, 2007an Amendment Number Two was approved to allow business activities in addition to hangar rental between the City and Officer Club Aero Ventures San Marcos #1, LP. 4. On February 19, 2008 the City Council approved Amendment Number Three to a Lease between the City of San Marcos and Officers Club AeroVentures San Marcos #1, LP to add Officers Club AeroVentures San Marcos #2, LP as an additional lessee. 5. Officers Club AeroVentures San Marcos #2, LP wishes to obtain the City's approval of a Business Use Agreement with Blue Skies Aviation, LLC to operate a general aviation repair and maintenance facility on the Leased Premises. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS: PART 1. The attached Agreement Authorizing Use of Airport Property for Operation of Business between Officers Club AeroVentures San Marcos #2, LP and Blue Skies Aviation is approved. PART 2. The Interim City Manager, Collette Jamison, is authorized to execute the agreement on behalf of the City. PART 3. This Resolution shall be in full force and effect from and after its passage.
