<br />1 <br /> <br />obligations of Officers Club AeroVentures San Marcos #2, LP in the City Lease with respect to the <br />following: <br />1. Placing or keeping anything on the Facility or use of the Facility for any purpose which <br />increases the insurance premium cost or invalidates any insurance policy carried on the <br />Facility. <br />2. Risk of loss and damage for all property kept, stored or maintained by it within the Facility. <br />3. Use of the Facility in any manner that results in waste of the Facility or constitutes a <br />nuisance, or violates any statute, ordinance, rule or regulation that applies to the Facility. <br />4. Keeping the Property, including ramps, signs, sidewalks, service ways, and loading areas <br />adjacent to the Property, neat, clean, and free from dirt and trash at all times. <br />5. Storage of all equipment, materials and supplies related to BLUE SKIES AVIATION, LLC' <br />activities. Outside storage is specifically prohibited without the advance written consent of <br />the Officers Club AeroVentures San Marcos #2, LP and the City. <br />6. Maintenance of the Facility in good and clean condition. <br />7. Compliance with all governmental laws, ordinances and regulations that apply to the <br />business operations on the Facility. <br />8. Securing the prior written consent of the City for any alterations, additions, or improvements <br />to the Facility. BLUE SHIES AVIATION, LLC acknowledges and agrees that all <br />improvements, alterations, additions and fixtures which are made or installed in or on <br />the Facility shall remain upon and be surrendered with the Facility upon any <br />termination of this Agreement, unless the City or Officers Club AeroVentures San <br />Marcos #2, LP requests their removal, in which event BLI1F SHIES A.VIATION,1<.T C <br />shall remove them and restore the Facility at BLUE SHIES AVIATION, LLC' expense. <br />All improvements which can be disassembled and moved to another location (i.e. paint <br />booths) shall be removed by BLUE SHIES AVIATION, LLC upon expiration or within <br />15 days of any termination of this Agreement. <br />9. Ensuring that no lien or similar obligation is imposed upon the Property for any alteration, <br />repair, labor performed or materials furnished to the Property or Facility, and immediately <br />discharging any lien or charge after the lien occurs or charges become due and payable. <br />10. Securing the prior written consent of the City for any of the following: 1) any changes to the <br />Facility; 2) installing any exterior lighting, shades or awnings, or any exterior decorations or <br />paintings on the Facility; or 3) erecting, installing or changing any signs, window or door <br />lettering, placards, decorations, or advertising media of any type which can be viewed from <br />the exterior of the Facility. <br />11. Promptly paying all charges for electricity, water, telephone service, and other utilities <br />furnished to the Facility. <br />12. Waiving any liability of the City for any interruption or impairment whatsoever in utility <br />services to the Facility. <br />13. Payment when due of due all taxes and assessments against any equipment, inventory and <br />other personal property at or in the Facility, and payment when due of all sales, excise, <br />income and other taxes levied upon its business operations at the Facility. <br />14. Procuring and maintaining liability insurance in full force at its expense as set forth in the <br />City Lease and in the Minimum Standards. This insurance shall be written so that the City <br />must be notified in writing at least 30 days in advance of cancellation, restrictive amendment <br />3 <br />
