ORDINANCE NO. 2009-48 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, APPROVING AN AMENDMENT TO THE <br />FUTURE LAND USE MAP FROM "LDR", LOW DENSITY <br />RESIDENTIAL, TO "MDR", MEDIUM DENSITY RESIDENTIAL, <br />FOR A 0.2583 ACRE, MORE OR LESS, TRACT OF LAND LOCATED <br />AT 407 A AND B SARAH STREET; AMENDING THE OFFICIAL <br />ZONING MAP OF THE CITY BY REZONING THIS TRACT FROM <br />"SF-6", SINGLE FAMILY RESIDENTIAL DISTRICT TO "DR", <br />DUPLEX RESTRICTED DISTRICT; AND INCLUDING <br />PROCEDURAL PROVISIONS <br />RECITALS: <br />1. On August 11, 2009, the Planning and Zoning Commission of the City of San Marcos <br />held a public hearing regarding a request to change the Future Land Use Map of the San Marcos <br />Horizons City Master Plan from "LDR", Low Density Residential, to "MDR", Medium Density <br />Residential, and a concurrent request to change the zoning from "SF-6", Single Family <br />Residential District, to "DR", Duplex Restricted District, for a 0.2583 acre, more or less, tract of <br />land located 407 A and B Sarah Street. <br />2. Subsequent to the public hearing on that date, the Planning and Zoning Commission <br />considered and voted to approve the requests on August 11, 2009, and recommended that the <br />requests be approved by the City Council of the City. <br />3. The City Council held a public hearing on September 1, 2009 regarding the requests. <br />4. All requirements of Chapter 1, Development Procedures, of the City Land <br />Development Code pertaining to Future Land Use Map Amendments and Zoning Map <br />amendments have been met. <br />5. The City Council hereby finds and determines that the adoption of the following <br />ordinance is in the interest of the public health, morals, welfare and safety. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The Future Land Use Plan of the San Marcos Horizons City Master Plan is <br />revised to change the future land use designation for the following real property from "LDR", <br />Low Density Residential, to "MDR", Medium Density Residential: <br />Street address: 407 A and B Sarah Street <br />0 Size: 0.2583 acres, more or less
