0 RESOLUTION NO. 2009-114R <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF <br />SAN MARCOS, TEXAS APPROVING AN AMENDMENT TO <br />THE WATER SUPPLY CONTRACT WITH THE HAYS <br />CALDWELL PUBLIC UTILITY AGENCY; AND DECLARING <br />AN EFFECTIVE DATE <br />RECITALS: <br />1. The governing bodies of the City, the City of Buda, the City of Kyle, and the <br />Canyon Regional Water Authority (collectively, the "Participating Public Entities") have <br />adopted resolutions approving the creation of the Hays Caldwell Public Utility Agency <br />(the "Agency") under Texas Local Government Code Chapter 422, as amended (the <br />"PUA Act"). <br />2. The Participating Public Entities have previously entered into a Water Supply <br />Contract that defines the amount of water each participating entity will require from the <br />project. Periodically, due to changes in demand, the proportional amount received by <br />each entity may change, necessitating a change to the Contract. This Amendment to the <br />Contract reflects changes in proportional amounts received by each entity. The City's <br />proportional amount will decrease from 39.7% to 35.86%; however, this proportional <br />amount is equivalent to 11,910 acre feet of water, the amount needed from this source to <br />meet the City's projected needs until the year 2060. <br />BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS: <br />PART 1. The City Manager, Rick Menchaca, is authorized to execute the <br />advance funding agreement on behalf of the City. <br />PART 2.
