<br />124. <br />Regular Meeting July 10, 2000 Page 4 <br /> <br /> <br />Ms. Hughson moved to remove this matter from the table and for adoption <br />and Mr. Moseley seconded the motion. With this agreement Hays Energy will <br />have a right of first call, and the City can serve other customers on this <br />line. They will only need intermittent service. In response to Ms. <br />Hughson's query, Mr. Gilley stated any wastewater the City receives must <br />meet all industrial pretreatment requirements. Mr. Moseley moved to amend <br />the Resolution in Section 2.04F of the Water Supply Contract to read, ~F. <br />The Seller will ensure that any connections made (deletion) to the Supply <br />Line to serve other customers are equipped in such a way as to ensure that <br />the Seller is able to comply (deletion) with its supply obligations <br />hereunder," and to amend the Wastewater Services Agreement in Section 2.03 <br />under Parameter, to "limit the quantity of its discharged wastewater to <br />500,000 rather than 2,175,000 gallons per day," and Ms. Hughson seconded <br />the motion, which passed unanimously. The Council then voted unanimously <br />for adoption of the Resolution. <br /> <br />Mayor Chiu introduced for consideration approval of the minutes of the <br />Regular Meeting held June 26, 2000, approval of two Ordinances on second <br />reading, adoption of two Ordinances on third and final reading, adoption <br />of seven Resolutions and approval for funding in the amount of $800.00 <br />from the Tourist Account for an exhibit space at the Texas Municipal <br />League Conference in Austin, Texas on November 15-18, 2000 on consensus. <br />The Council removed Items 9.B. (10), approval of an Ordinance on second <br />reading, 9.D. (6) and 9.D. (7), adoption of Resolutions, and approval for an <br />expenditure from the Tourist Account to be considered separately. Mr. <br />Hughson moved for approval of the minutes of the Regular Meeting held June <br />26, 2000, approval of the remaining Ordinance on second reading, adoption <br />of the two Ordinances on third and final reading, and adoption of the <br />remaining five Resolutions on consensus and Mr. Mayhew seconded the <br />motion, which passed unanimously. The captions of these Ordinances and <br />Resolutions read as follows: <br /> <br />Approval of Ordinance on second reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />RENEWING THE EXISTING FRANCHISE AGREEMENT BETWEEN THE CITY AND THE <br />PEDERNALES ELECTRIC COOPERATIVE, INC.; REVISING THE METHODOLOGY FOR <br />DETERMINING FRANCHISE FEE PAYMENTS; PROVIDING FOR WRITTEN ACCEPTANCE <br />TO BE FILED BY THE PEDERNALES ELECTRIC COOPERATIVE; AND PROVIDING AN <br />EFFECTIVE DATE. <br /> <br />Adoption of Ordinances on third and final reading: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING CHAPTER 106, SIGNS, OF THE SAN MARCOS CITY CODE, PROVIDING <br />FOR SEVERABILITY; REPEALING ALL CONFLICTING ORDINANCES; PROVIDING FOR <br />PUBLICATION AND PROVIDING AN EFFECTIVE DATE. <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 58.127 OF CHAPTER 58, PUBLIC FACILITIES, PARKS AND <br />RECREATION OF THE CITY CODE BY ADDING LANGUAGE TO ALLOW FREE LIBRARY <br />ACCESS TO MINORS RESIDING IN THE AREA OF THE SAN MARCOS SCHOOL <br />DISTRICT; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Adoption of Resolutions: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AUTHORIZING PARTICIPATION IN THE TEXAS LOCAL GOVERNMENT INVESTMENT <br />POOL (~TEXPOOL"); DESIGNATING AUTHORIZED REPRESENTATIVES ON BEHALF OF <br />THE CITY; APPROVING A PARTICIPATION AGREEMENT BETWEEN THE CITY AND <br />TEXPOOL; AUTHORIZING THE CITY MANAGER TO EXECUTE THE AGREEMENT AND <br />RELATED DOCUMENTS ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE <br />DATE. <br />
