City Council <br />Meeting Minutes September 30, 2019 <br />Shannon Mattingly, Director of Development Services, stated that the Gilbane <br />Development Company no longer has the properties under contract, however <br />the property owners have given permission to move forward and they no <br />longer have an interest in further negotiations. <br />Council Member Rockeymoore asked what the developer is able to develop on <br />that property if we were to deny this evening. Ms. Mattingly stated they would <br />be able to develop under CD -51) zoning which is multi -family and there is a <br />limitation of 3 bedrooms. <br />The motion to deny carried by the following vote: <br />For: 7 - Mayor Pro Tem Prewitt, Council Member Gonzales, Council Member Derrick, Mayor <br />Hughson, Council Member Mihalkanin, Council Member Marquez and Council <br />Member Rockeymoore <br />Against: 0 <br />21. Consider approval of Resolution 2019-185R, approving a Partial Assignment of a <br />Development Agreement from Craddock Avenue Partners, L.L.C. to Carson Diversified <br />Land, L.P. for an approximately 10 acre undeveloped portion of the Buie Tract located <br />along Craddock Avenue at Bishop Street; modifying the Development Agreement by <br />eliminating the requirements that all buildings be brought to the street edge of Craddock <br />Avenue and contain ground floor retail or office space, and by eliminating the requirement <br />that future assignments must be approved by the City; approving any other conditions to <br />the assignment or modifications to the development agreement as may be imposed by <br />the City Council; authorizing the City Manager to execute the partial assignment on behalf <br />of the City; and declaring an effective date. <br />MAIN MOTION: a motion was made by Council Member Rockeymoore, <br />seconded by Mayor Pro Tem Prewitt, to approve Resolution 2019-185R. <br />MOTION TO AMEND: a motion was made by Mayor Pro Tem Prewitt, <br />seconded by Council Member Gonzales, to amend Resolution 2019-185R, by <br />revising Section 4 (a) of the development agreement. <br />Buildings Along Craddock. Subsection BA of the Original Agreement shall be <br />deleted in full and replaced with the following: <br />Buildings in the Phase 1 MU tract must include, in the aggregate, at least 5,000 <br />square feet of retail/office space. Future platted lots within in the Phase 1 MU <br />tract abutting Craddock Street must include a principal building brought to <br />the street edge of Craddock Street, said street to include any public easement <br />grants to which the applicable lot is subservient. <br />The motion carried by the following vote: <br />City of San Marcos Page 11 <br />
