JOHN'S <br />CATHOLIC CHURCH EVEN START PROGRAM FOR THE SUBMISSION OF A COMMUNITY <br />NETWORKING GRANT APPLICATION WITH THE TELECOMMUNICATIONS <br />INFRASTRUCTURE BOARD OF TEXAS; RATIFYING THE CITY MANAGER'S EXECUTION <br />OF THE INTERLOCAL AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING THE TERMS AND CONDITIONS OF AN EARNEST MONEY CONTRACT <br />BETWEEN THE CITY AND TETCO, INC. FOR THE PURCHASE OF LAND FOR A NEW <br />FIRE STATION SITE ON HUNTER ROAD; AUTHORIZING THE CITY MANAGER TO <br />EXECUTE THE CONTRACT ON BEHALF OF THE CITY AND DECLARING AN EFFECTIVE <br />DATE. <br /> <br />Mayor Chiu introduced for consideration Item 7.B. (1) removed from the <br />consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING SECTION 2.091 OF THE CITY CODE TO PROVIDE FOR THE <br />APPOINTMENT OF ALTERNATE MEMBERS TO THE PLANNING AND ZONING <br />COMMISSION; PROVIDING FOR PENALTIES; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />Mr. Moseley moved for approval of the Ordinance on second reading and Mr. <br />Doiron seconded the motion. Mr. Moseley moved to amend the Ordinance in <br />Section 1. (b) for the last sentence to read, "One of the alternate members <br />will reside and own real property in the city, and the other alternate <br />member may reside and own property in the city's extraterritorial <br />jurisdiction," and Mr. Doiron seconded the motion, which passed <br />unanimously. The Council then voted unanimously for approval of the <br />Ordinance on second reading. <br /> <br />Mayor Chiu introduced for consideration Item 7.F. removed from the consent <br />agenda, denial of sale of City-owned property in the Schulle Canyon <br />Greenbelt behind 1412 Alamo to Kenneth Dees. Ms. Hughson left the <br />Chambers and did not participate in this discussion. Mr. Doiron moved for <br />denial of the sale of City-owned property in the Schulle Canyon Greenbelt <br />behind 1412 Alamo to Kenneth Dees and Mr. Moseley seconded the motion. <br />Mr. Dees advised the Council he has been trying to buy this property for <br />years from Chester Witte and from the City when the City first acquired <br />the property. He stated his neighbors, the Hindsons and Ralphs were in <br />support of this matter. He wants to purchase this property to have a <br />buffer between his property and the greenspace. He stated he has a loss <br />of privacy with the greenspace and that is why he needs this buffer. Mr. <br />Cox asked if all neighbors bordering Schulle Canyon have the same <br />circumstance, and Mr. Gilley stated there are other property owners with <br />similar circumstances. Mr. Cox asked Mr. Gilley if there were any <br />assurances Mr. Dees' privacy would not be disturbed, and Mr. Gilley stated <br />no. Mr. Dees stated his property is in a flat area where people will be <br />accessing and will be looking in his backyard. Mr. Doiron stated he was <br />concerned with the precedent this would set if the City were to sell its <br />greenspace. Mr. Dees stated the property is still zoned R-l, and he <br />thinks this would be the time for the City to consider his request prior <br />to the greenspace being rezoned. Mr. Ed Theriot advised the Council the <br />Sector 3 Plan would be coming to the Council for consideration in <br />November, and it would be appropriate for the greenspace to be rezoned <br />after the Sector Plan is adopted. The Council unanimously voted to deny <br />the sale of this property. <br /> <br />Mayor Chiu introduced a discussion regarding the CARTS Bus Service. David <br />Marsh provided a handout to the Council, a copy of which is attached to <br />
