A. Carson agrees to dedicate by Final Plat 100 feet of Right Of Way. in the location <br />indicated on Exhibit "B". Said Final Plat will be submitted to the City for <br />consideration within one year of the date of this agreement. <br />B. Carson agrees to fund 75% of the cost and to construct 100% of Stagecoach Drive in <br />the location indicated on Exhibit "B". <br />C. With the exception of the light signal, discussed below, Carson will complete the <br />construction of the Public Facilities on or before June 20, 2009. <br />D. Carson agrees to fund 50%, not to exceed $50,000, of the cost of a future traffic signal <br />light to be installed by the City at the intersection of Stagecoach Drive and <br />Wonderworld Drive if the installation occurs within five (5) years of the date of this <br />agreement. Said money will be payable to the City at the time the City Council <br />awards the contract for the signal construction. <br />E. All infrastructure will be constructed in accordance with the City's Land <br />Development Code. <br />2. Agreements by the City. The City agrees as follows: <br />A. City agrees to accept the dedication by Final Plat of 100 feet of RightOf Way in the <br />location indicated on Exhibit "B". Said Final Plat will be submitted to the City for <br />Consideration within one year of the date of this agreement. <br />B. City agrees to fund 25% of the cost, in an amount not to exceed $167,922.00, of the <br />construction of Stagecoach Drive in the location indicated on Exhibit "B". <br />C. .City agrees to accept the 50% funding provided by Carson, in an amount not to <br />exceed $50,000, of the cost of a future traffic signal light to be installed by the City at <br />the intersection of Stagecoach Drive and Wonderworld Drive if the installation occurs <br />within five (5) years of the date of this agreement. Said money will be payable to the <br />City at the time the City Council awards the contract for the signal construction. The <br />City will obtain the remainder of the funding for the traffic signal light from sources <br />other than Carson. <br />3. Miscellaneous Provisions. <br />A. Entire Agreement; Assignment. This Agreement constitutes the entire agreement <br />between the parties hereto and may be amended only by a written document signed by the <br />Parties. This Agreement will be binding upon the successors and assigns of the Parties. <br />B. Venue; Governing Law. This Agreement shall be construed and enforced according to <br />the laws of the State of Texas; and exclusive venue for any legal action arising under this <br />Agreement shall lie in Hays County, Texas.
