RESOLUTION STATE OF TEXAS COUNTY OF HAYS WHEREAS, The Village of San Marcos (the Village), a Texas nonprofit corporation exornpted under Section 541(0)(3) of the United States internal Revenue code, submitted an application to Hays County for the funding of a park protect through their 2007 park bond program, and, WHEREAS, the Village has agreed to provide and. Maintain a puloc park faaifty on their property located on Reimer Ave, that will include a sports complex consisting of three food fads, a parking area and a concession stand/restroom facility, along with recreation amenk*s such as picnic facilities, playground equipment, a basketball court, and a pavilion and other Improvemettta more fully described in Exhibit W of an interiocal Agreement between the City of San Marcos, Texas and Hays County, Texas date March 11, 2409; and, WHEREAS, the Hays County Commissioners Court, on January 22, 2048 approved the funding of this protect which will Include in addition to the park facilities the construction of a roadway access and utility extension to the sports complex in an amount not to exceed $1,616,417: and, WHEREAS, the County has requested that the City of San Marcos (the city) assist with prated oversight during the engineering; procurement, and construction phases of this protect; and, WHEREAS, Hays County and the City of San Martins will enter Irmo an intertacal Agreemertt dated March 11, .2408 that details the responsibilities Of each entity rind sets forth the terms under which this funding has been approved forthe Village; and, NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of The Village of Son Manes: 1. The Village acknowledges that. the Board has received and reviewed a copy (attached hereto) of the Inter-Local Agreement (ILA) between Hays County and the City of San Marcos with regard to the construction of a parks facility and roadway access on The Viliago's campus located on Reimer Avenue. The Board haft. no objections to the terns and conditions of the ILA4 2. The Village will act in accordance with the terms and conditions of the ILA where appropriate, will perform all Sets specifically assigned therein to the Village, and will cooperate with and assist the parties to the ILA in achieving the terms and Conditions of the ILA as needed. S. The Village will amend the agreement with the City of Marcos to aCCOMModate appropriate provisions In the ILA. 4. The Village will use the funds provided by Hays. County solely for the purposes forwhich they are provided.
