T <br />INTERLOCAL AGREEMENT BETWEEN THE CITY OF SAN MARCOS, TEXAS AND <br />HAYS COUNTY, TEXAS FOR THE DEVELOPMENT OF PARK FACILITIES AT A SITE <br />OWNED BY THE VILLAGE OF SAN MARCOS, INC. <br />This Agreement is made and entered into by Hays County, a political subdivision of the <br />State of Texas ("County") and the City of San Marcos, Texas ("City") under the authority of <br />Chapter 791, of the Texas Government Code. <br />For and in consideration of the mutual agreements herein exchanged, County and City <br />hereby contract as follows: <br />1. Purpose and Legal Authority. <br />1.1 The purpose of this Agreement is to provide for the design, bidding, and <br />construction of a public park facility on property owned by the Village of San <br />Marcos, a Texas nonprofit corporation exempted under Section 501(c)(3) of the <br />United States Internal Revenue Code (the "Village) and located on Reimer Avenue <br />in San Marcos, Texas that will include a park access road, a sports complex <br />consisting of three football fields, a parking area, a concession stand/restroom <br />facility, recreational amenities such as picnic facilities, playground equipment, a <br />basketball court, and a pavilion as described in Exhibit "A", attached hereto and <br />incorporated herein by reference and collectively referred in this Agreement as "the <br />Project." The location of the park facility on the site is depicted on a Concept Plan <br />attached as Exhibit "B." As more specifically provided herein, the County is <br />providing funding for construction of the Project using bond funds and the City is <br />providing funding for the design of the Project and furnishing administrative <br />oversight and supervision during the design, bidding, and construction phases of the <br />Project. City and County, as units of local government, are authorized by §791.011
