February 5, 2008 <br />Page 2 <br />With a quorum present, the Regular Meeting of the San Marcos City Council was called to order by Mayor Susan <br />Narvaiz at 6:02 p.m. on Tuesday, February 5, 2008 in the Council Chambers of the City of San Marcos City Hall, <br />630 East Hopkins, San Marcos, Texas 78666. <br />3. Executive Session <br />In accordance with the Texas Government Code, Section 551.071 - City Attorney's advice, and 551.074 — Duties <br />of a Public Officer, the San Marcos City Council convened into Executive Session at 6:04 p.m. on Tuesday, <br />February 5, 2008 in order to continue discussing matters pertaining to: <br />A. City Attorney advice - Kleinman vs. City of San Marcos <br />B. City Attorney advice — Contract for Collection and Disposal of Solid Waste and Recyclable Materials <br />C. Duties of a Public Officer — Interim City Manager <br />The Executive Session adjourned at 6:51 p.m. on Tuesday, February 5, 2008. <br />4. Reconvene and Consider Action on Item Discussed During Executive Session. <br />The San Marcos City Council reconvened into regular session at 6:51 p.m. on Tuesday, February 5, 2008. No <br />action was required from Executive Session. <br />5. Invocation <br />Rev. Samuel Montoya, pastor of the Sinai Pentecostal, provided the invocation. <br />6. Pledge of Allegiance <br />7. Citizen Comments <br />Margaret Guzaldo, 734 W. Hopkins, stated she wished to speak regarding Item #23, ordinance. She stated she <br />grew up on the street, and a few years ago she was able to buy the same house and move back with her three <br />children. She stated she feels it is important to have a contiguous historic district and she worries about losing <br />property values if it is not an historic district. <br />Joe Ptak, 505 Patricia Dr., stated he feels he has had encounters with local law enforcement. He encouraged the <br />Council to amend the current Land Development Code. <br />Charlotte Endsley, 107 Nichols Dr., stated she wished to speak regarding Item # 30, discussion. She stated she <br />attended the rental task force meeting where the proposed rental ordinance was reviewed. She stated this <br />Ordinance places an undue burden on tenants, property managers, and owners; an undue economic strain is <br />passed down to the tenants. She also encouraged the Council to enforce the littering and trashcan issues all over <br />San Marcos. <br />Alexis Cline, 726 W. Hopkins, stated she wished to speak regarding Item #23, discussion. She stated she has <br />lived on Hopkins Street for five years. She encouraged the Council to support this ordinance. <br />
