(5) Other conditions deemed appropriate by the control authority to ensure <br />compliance with this division. <br />(d) The control authority shall be enabled to control through permit, order, or similar <br />means, the contribution to the POTW by each industrial user to ensure compliance with <br />applicable pretreatment standards and requirements. In the case of industrial users <br />identified as significant under 40 CFR 403.3(t), this control shall be achieved through <br />permits or equivalent individual control mechanisms issued to each user. <br />(e) It is the responsibility of the industrial user to notify the control authority prior to any <br />substantial change in process, change in character or quantity of wastewater or change in <br />signatory authority. These changes may require issuance of a new permit. <br />(f) Permits are nontransferable except as provided in subsection (e) of this section. <br />(g) Permits are valid for a period not to exceed three years from the date of issuance. <br />They will be reviewed annually, but may be modified at any time as the control authority <br />deems necessary. <br />(h) Permits may be revoked if the requirements for self-monitoring, reporting, <br />compliance and any other requirements set forth in the permit or in this division are not <br />being met. The industrial user must immediately cease discharge upon permit revocation. <br />(i) If the director denies the permit or disapproves it pending receipt of additional <br />information, the director shall notify the applicant in writing via certified mail. The notice <br />letter to the applicant shall be accompanied by a detailed statement of the reasons for the <br />action. The reasons shall be based upon sections in this division. <br />(j) Prior to renewal of the industrial waste permit, the applicant shall provide the director <br />with evidence that all residues generated by pretreatment systems have been legally <br />disposed of in accordance with all federal, state and local regulations. <br />(k) Administrative fees for new permit issuance, permit renewal, permit transfer to <br />different ownership, surcharges and billing procedures are established by the city council. <br />(1) Application for a permit renewal with the permit renewal fee shall be sent to the <br />director by certified mail at least 60 days prior to the permit expiration date. If the <br />director has not received the permit renewal application and renewal fee 60 days prior to <br />the permit expiration date, an application for a new permit issuance is required. <br />(m) Prior to the change of ownership of an i~~- industrial user, the new owner may <br />have an existing valid industrial waste permit for that industrial user transferred <br />into its name by providing written notice to the control authority and submitting a transfer <br />fee and permit application containing sufficient information regarding the discharge of <br />pollutants, including those referred to in section 307(a) of the Act, as amended, and listed <br />in appendix B to 40 CFR 403. <br />
