Mr. Mihalkanin stated substantial <br />changes have been made to this Ordinance and the Noise Ordinance. He <br />stated the two Ordinances are so intertwined and because of the concern <br />expressed by the community, he thought the Council should consider tabling <br />the Ordinances to hold a public meeting and discuss the issues. Mr. <br />Mayhew asked if Chief Griffith had any comments, and Chief Griffith stated <br />he met with rental property managers in San Marcos to discuss the Party <br />and Noise Ordinances today and commented on the changes. Mr. Mihalkanin <br />stated the City Attorney's Office and Police Department should provide <br />support at a public meeting. Ms. Tatum stated during citizen comment <br />several comments were made by citizens that they wanted the opportunity to <br />provide input, and Ms. Tatum would be in favor of this happening provided <br />this is done quickly. Council discussed the need to allow time for the <br />public meeting. Mr. Mihalkanin then moved to table this matter until <br />March 25 and Mr. Montoya seconded the motion, which passed unanimously. <br />Mayor Chiu introduced for consideration Item 19 removed from the consent <br />agenda, adoption of an Ordinance on third and final reading, the caption <br />which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING DIVISION 3 OF ARTICLE 3 OF CHAPTER 34, ENVIRONMENT, OF THE <br /> SAN MARCOS CITY CODE TO ADD REGULATIONS PERTAINING TO NOISE FROM <br /> VEHICLES AND FROM PARTIES IN RESIDENTIAL AREAS; INCLUDING PROCEDURAL <br /> PROVISIONS; PROVIDING FOR PENALTIES; AND PROVIDING AN EFFECTIVE DATE. <br />Mr. Cox moved for adoption of the Ordinance on third and final reading and <br />Ms. Hughson seconded the motion. Mr. Mihalkanin then moved to table this <br />Ordinance until March 25 and Ms. Tatum seconded the motion, which passed <br />unanimously. Mr. Gilley stated they will publicize a meeting and make <br />copies of the Ordinances available at City Hall, at the meeting and on the <br />website, and will provide copies to neighborhood representatives. <br />Mayor Chiu introduced for consideration Item 20 removed from the consent <br />agenda, adoption of a Resolution, the caption which was read as follows: <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> APPROVING THE RESALE OF A PARCEL OF REAL PROPERTY LOCATED IN THE 300 <br /> BLOCK OF CHEATHAM STREET THAT WAS FORECLOSED FOR UNPAID TAXES; AND <br /> DECLARING AN EFFECTIVE DATE. <br />Mr. Mihalkanin moved for adoption of the Resolution and Ms. Tatum seconded <br />the motion. fv1r. Mayhew stated we would only be recovering 19% of the <br />total judgment. Mr. Taylor stated access to this property is a dedicated <br />platted street that is not paved and is called an alley, which abuts a <br />commercial development. Mr. Mihalkanin asked if the City had a legal <br />obligation to pave it, and Mr. Taylor stated no. Ms. Hughson asked if the <br />City had marketed the sale in any way, and Mr. Gilley stated not that he <br />was aware of.
