<br /> 40. <br />Regular Meeting January 28, 2002 Page 5 <br />stated this property adds to the backside of an existing office. The <br />Council voted unanimously for adoption of the Zoning Ordinance. <br />Mayor Chiu introduced the continuance of a public hearing from the January <br />14, 2002 Council Meeting and adoption of a Zoning Ordinance, the caption <br />which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING A 30.66 ACRE <br /> TRACT OF PROPERTY LOCATED AT 508 CRADDOCK AVENUE, FROM "R-l" (SINGLE- <br /> FAMILY DWELLING DISTRICT [LOW DENSITY]) TO "PDD" (PLANNED DEVELOPMENT <br /> DISTRICT); INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br /> PENALTIES. <br />Mayor Chiu opened the public hearing and asked if anyone wished to speak. <br />Regina Criswell stated she is an attorney representing Dr. Weatherford. <br />Ms. Criswell stated Dr. Weatherford's first application process begain in <br />1996, and when he determined there was neighborhood opposition, he <br />withdrew his application. The Sector 2 process began, and a consensus was <br />reached to hold a charette to address the Weatherford property, and many <br />participated in this process. A report on the agreement reached in the <br />charette in 1997 was provided to the City Council. After that time many <br />opposed the decision of the charette. Dr. Weatherford's zoning was <br />denied. Ms. Criswell stated the PDD zoning was never made a part of the <br />charette. Dr. Weatherford filed an application to go through the PDD <br />process and filed in protest. Ms. Criswell stated petitions were filed, <br />and signatures may not have been received legally. Ms. Criswell stated <br />Dr. Weatherford wants the agreement of the charette upheld. Ms. Criswell <br />stated Dr. Weatherford has not been treated fairly, and there is no basis <br />for denial on any technicality. Camille Phillips stated she had asked for <br />the charette process November 22, 1997, and that conditions have changed <br />surrounding the Weatherford property since that time. She is opposed to <br />this zoning request. Ms. Phillips stated she would be interested in <br />hearing more about illegal petitions and meetings with Council. John <br />McBride of 703 Franklin in Oak Heights stated he has spent time away from <br />his family because he was at City Hall protecting the property of homes <br />and protecting property rights and San Marcos' quality of life. He stated <br />there are homeowners who are also aggrieved. No one else wished to speak, <br />so Mayor Chiu closed the public hearing. Mr. Mihalkanin moved for <br />adoption of the Zoning Ordinance and Ms. Tatum seconded the motion. Mr. <br />Cox stated the Staff has recommended denial of this zoning request, and <br />the site plan is not in conformity with the Sector Plan. On roll call for <br />adoption of the Zoning Ordinance, the Council unanimously denied this <br />Ordinance. <br />Mayor Chiu introduced for consideration adoption of an Ordinance on <br />emergency, the caption which was read as follows: <br /> AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br /> IMPOSING A TEMPORARY MORATORIUM ON THE ISSUANCE OF PERMITS FOR THE <br />
