ORDINANCE NO. 2020-14 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN <br />MARCOS, TEXAS, ADOPTING FEES TO BE CHARGED BY THE CITY <br />FOR VARIOUS PARKS AND RECREATION FACILITIES, INCLUDING <br />CHANGES TO EXISTING FEES; PROVIDING A SAVINGS CLAUSE; <br />PROVIDING FOR THE REPEAL OF ANY CONFLICTING PROVISIONS; <br />AND PROVIDING AN EFFECTIVE DATE. <br />flairell-KIM <br />Pursuant to applicable provisions of State law and City ordinances, the City Council may <br />establish fees to be charged for various City services to recover costs to the City associated with <br />the use of such facilities. <br />BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF SAN MARCOS, <br />TEXAS: <br />SECTION 1. The City Council hereby adopts the fees to be charged for various City <br />services as set forth in Exhibit "A," attached hereto and made a part hereof for all purposes. <br />SECTION 2. Any such fees provided for under Section 1 will be waived for a nonprofit <br />organization receiving Community Development Block Grant (CDBG) funding or human services <br />grants for the provision of social and human services or programs when the nonprofit organization <br />is utilizing a city facility to provide social and human services or programs to the community, and <br />not for fundraising or similar events. <br />SECTION 2. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 4. All ordinances and resolutions or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. To the extent the provisions of any ordinance provide <br />for establishment of a fee or fees by resolution of the City Council, such provisions are superseded <br />by this ordinance and the fees as adopted in this ordinance shall govern. <br />SECTION 5. After its passage, approval and adoption on second reading, this ordinance <br />shall be effective on September 1, 2020. <br />PASSED AND APPROVED on first reading on March 17, 2020. <br />PASSED, APPROVED AND ADOPTED on second reading on April 7, 2020. <br />0,.. <br />J ne Hughson <br />Mayor <br />
