<br />179. <br /> <br />Regular Meeting <br /> <br />August 12, 2002 <br /> <br />Page 6 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />AMENDING CHAPTER 82, TRAFFIC AND VEHICLES, TO RAISE PARKING FINES; <br />INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR PENALTIES. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading and Ms. <br />Tatum seconded the motion. Mr. O'Leary stated Staff recommends the Council <br />table this item until after further discussions with Southwest Texas State <br />University. Mr. Mayhew stated he is concerned with the discrepancy between <br />fines the University charges and the City charges. Ms. Narvaiz stated she <br />would like Staff to update Council with alternatives which can be used <br />between now and when the downtown parking plan is in effect. Mr. <br />Mihalkanin moved to table this item for six months and Ms. Narvaiz seconded <br />the motion. On roll the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Montoya, Narvaiz, Habingreither, Taylor and Tatum. <br /> <br />NAY: <br /> <br />Mayhew. <br /> <br />ABSTAIN: <br /> <br />None. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on second reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REVISING AND UPDATING CHAPTER 6, ANIMALS, OF THE CITY CODE; REVISING <br />CHAPTER 2, ADMINISTRATION, TO ESTABLISH A NEW ANIMAL SHELTER ADVISORY <br />COMMITTEE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Ms. Tatum moved for approval of the Ordinance on second reading and Mr. <br />Mayhew seconded the motion. Ms. Narvaiz asked what is the average monthly <br />complaints for neglect. Bert Stratemann, Animal Services Manager, stated <br />they receive 650 calls for service a month and one-fourth of those are for <br />abuse and cruelty. He stated not all are abuse, but the calls still have <br />to be investigated. Mayor Habingreither stated he has some concerns with <br />an Ordinance being stricter than State and Federal Laws. Ms. Russell stated <br />animal cruelty is a Class C misdemeanor. A person can be ticketed if <br />called more than once. Education is needed to prevent this from occurring. <br />Mr. Taylor stated he thinks the City would be better off educating the <br />Public rather than creating stricter Ordinances. Mr. Mihalkanin stated he <br />feels this Ordinance should be passed and before the third and final <br />reading Council should individually work with staff to modify the language <br />of the Ordinance. Mayor Habingreither stated he feels the language in <br />Section 6.085 of the proposed Ordinance is too strong and would like Staff <br />to modify this section. Dr. Tom House stated this Ordinance calls for <br />swines to be vaccinated, and currently there is no approved vaccination for <br />swines. Francis McNair, of Friends of the San Marcos Animal Shelter stated <br />she feels Section 6.085 is not strong enough. She stated there needs to be <br />a time limit to spay or neuter an adopted animal. There needs to be a <br />minimunl standard of care, because many don't care for their animals. She <br />
