<br />2. <br /> <br />Regular Meeting <br /> <br />August 26, 2002 <br /> <br />Page 2 <br /> <br />weekend in May, instead of the first weekend of June. 3) Sharri Boyett <br />stated she wished to speak on item 10 regarding the Animal Ordinance. She <br />stated this Ordinance is to help place the responsibility on the pet owner. <br />She encouraged the Council to do a Proclamation to encourage people to spay <br />or neuter their pets. She requested the City establish a fund to accept <br />donations. 4) James E. Byrn stated he wished to speak on item 31 regarding <br />a discussion of the Land Development Code. He suggested the Council should <br />require the developers to meet with the neighborhoods and the development <br />plans be brought before the Planning and Zoning Commission only if <br />requested by the developer or by Staff. He stated he disagrees with the <br />plans being reviewed after the developer has already spent a lot of money. <br />5) Dr. Randy Rogers stated he wished to speak on Item 31 regarding a <br />discussion of the Land Development Code. He stated he served on the Policy <br />Steering Committee and feels strongly against the development plat <br />replacing the preliminary plat. He also stated he dislikes the idea of <br />having the developers spend a lot of money in engineering fees before the <br />plat is reviewed or approved by the Planning and Zoning Commission. He <br />stated this would discourage favorable projects from corning to our <br />community. He also urged the Council to include some tree preservation. <br />6) Sherwood Bishop stated he wished to speak on Item 31 regarding a <br />discussion of the Land Development Code. He stated he was a member of the <br />Development Task Force, which worked with the consultant on this Code. He <br />also stated he agrees with the consultant's recommendations and urged the <br />Council to continue with the process. <br /> <br />Mayor liabingreither introduced for consideration approval of two <br />appointments to the Human Development Commission. No nominations were <br />received and this will be rescheduled. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />approval of an Ordinance on first reading, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />M1ENDING SECTION 114.027 OF THE CITY CODE REGARDING THE APPEAL OF <br />DECISIONS OF THE PLANNING AND ZONING COMMISSION OF SPECIFIC USE <br />PERMITS TO THE CITY COUNCIL; INCLUDING PROCEDURAL PROVISIONS; AND <br />PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. No one wished to speak, so Mayor Habingreither closed the public <br />hearing. Mr. Taylor moved for approval of the Ordinance on first reading <br />and Ms. Narvaiz seconded the motion. Mayor Habingreither stated he was <br />concerned with the % majority of the Council being needed to overturn the <br />Planning and Zoning Commission's recommendation for the denial of a <br />rezoning. Mr. Mark Taylor stated this is now a Charter requirement. The <br />Council then voted unanimously for approval of the Ordinance on first <br />reading. <br />
