<br />9. <br /> <br />Regular Meeting <br /> <br />August 26, 2002 <br /> <br />Page 9 <br /> <br />Government Code, Section 551.071, to seek the City Attorney's advice <br />regarding pending litigation, contemplated litigation, a settlement offer, <br />or a matter involving attorney-client privilege (Gary vs. City of San <br />Marcos; Burkett Transit Advertising Agreement; TNRCC Appropriation Permit <br />Application); and Section 551.074, to discuss appointment of officers <br />(Planning and Zoning Commission) and duties of a public officer (City <br />Manager). Mr. Mihalkanin moved the Council adjourn into Executive Session <br />at 9:46 p.m. and Mr. Mayhew seconded the motion, which passed unanimously. <br /> <br />Mr. Mayhew moved the Council reconvene at 12:12 a.m. and Ms. Narvaiz <br />seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration Item 24 removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPOINTING DANIEL J. O'LEARY AS CITY MANAGER; APPROVING AN EMPLOYMENT <br />AGREEMENT WITH DANIEL J. O'LEARY FOR THE POSITION OF CITY MANAGER; AND <br />PROVIDING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Mr. Montoya <br />seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 12:14 a.m. on motion made by Mr. Mihalkanin and <br />seconded by Mr. Montoya. <br /> <br />~ B .
