He stated he does not <br />support the changes which are being proposed in the draft Ordinance. Ms. <br />Tatum stated this is a tough issue and she does appreciate all the <br />participation in the process. She stated it would be hard for her to make <br />a decision, which would impose on local restaurants. She stated she feels <br />there does not need to be an Ordinance to make restaurants nonsmoking. They <br />should be able to chose for themselves. Mayor Habingreither stated he <br />feels businesses should have the opportunity to run their own businesses. <br />He stated he does not support a change in the current Ordinance. Mr. <br />Montoya stated he has no comment at this time regarding this issue. Ms. <br />Tatum stated she would be interested in looking at this issue again if the <br />Clean Air Now Coalition and the Hospitality Organization could work out a <br />compromise together. Mr. Mayhew stated as far as he is concerned, the <br />Council has spoken. He stated four Council Members have stated they are <br />not interested in changing the current Ordinance. <br /> <br />Mayor Habingreither introduced the City Council's Report. Ms. Narvaiz <br />stated on behalf of the Main Street Advisory Board, she wanted to invite <br />everyone to the Sights and Sounds on December 4-6, 2002. <br /> <br />Mayor Habingreither introduced an Executive Session pursuant to the <br />Government Code, Section 551.071 to seek the City Attorney's advice <br />regarding pending litigation, contemplated litigation, a settlement offer, <br />or matter involving attorney-client privilege (disannexation of Southwest <br />San Marcos area¡ Purgatory Greenspace Annexation¡ election campaign flyer). <br />Mr. Mihalkanin moved the Council adjourn into Executive Session at 12:04 <br />a.m. and Ms. Narvaiz seconded the motion, which passed unanimously. <br /> <br />Mr. Mihalkanin moved the Council reconvene at 12:42 a.m. and Ms. Tatum <br />seconded the motion, which passed unanimously. <br /> <br />The meeting adjourned at 12:43 a.m. on motion made by Mr. Montoya and <br />seconded by Mr. Mihalkanin. <br /> <br />\ <br /> <br />~,J) ~. ~. <br /> <br /> <br />Robert B.
