Mayor Habingreither introduced a public hearing and adoption of a Zoning Ordinance, the caption which was read as follows: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 19, BLOCK 3 OF THE WESTOVER ADDITION, LOCATED AT 1321 FRANKLIN DRIVE, FROM "C" COMMERCIAL DISTRICT TO "R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW DENSITY) ¡ INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. Russell Smith stated he was the applicant in this Zoning Ordinance and was present to answer any questions the Council might have. Mayor Habingreither asked if anyone else wished to speak¡ no one did so, he closed the public hearing. Mr. Mayhew moved for adoption of the Zoning Ordinance and Mr. Taylor seconded the motion, which passed unanimously. Mayor Habingreither introduced a public hearing and adoption of a Resolution, the caption which was read as follows: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, AMENDING THE FUTURE LAND USE PLAN OF THE CITY MASTER PLAN FROM OPEN SPACE/FLOODWAY, COMMERCIAL, AND INDUSTRIAL TO COMMERCIAL AND INDUSTRIAL AND OPEN SPACE/FLOODWAY FOR A 239 ACRE, MORE OR LESS, TRACT OF PROPERTY LOCATED IN THE 2700 BLOCK OF IH-35 NORTH¡ AND DECLARING AN EFFECTIVE DATE. Mayor Habingreither opened the public hearing and asked if anyone wished to speak. Steve Ramsey, Baker-Aicklen & Associates, stated he represents the Perry Financial Corporation, the developer of this high quality project. He also stated he is available to answer any questions the Council might have. No one else wished to speak, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved for adoption of the Resolution and Ms. Tatum seconded the motion, which passed unanimously. PROJECT TO A PARKLAND AND RECREATIONAL FACILITIES ACCOUNT¡ REMOVING THE PARKLAND RESTRICTION ON A PORTION OF THE OLD SEWER TREATMENT PLANT PROPERTY IN THE 1300 BLOCK OF IH-35 NORTH¡ AND DECLARING AN EFECTIVE DATE.
