<br />4. <br /> <br />Regular Meeting <br /> <br />November 25, 2002 <br /> <br />Page 4 <br /> <br />stated he has recommended Ms. Jan Clark for the Assistant City Attorney <br />position. Ms. Tatum moved for approval of the appointment of Ms. Clark and <br />Mr. Taylor seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced a public hearing and adoption of a Zoning <br />Ordinance, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE OFFICIAL ZONING MAP OF THE CITY BY REZONING LOT 19, BLOCK <br />3 OF THE WESTOVER ADDITION, LOCATED AT 1321 FRANKLIN DRIVE, FROM "C" <br />COMMERCIAL DISTRICT TO "R-1" SINGLE-FAMILY DWELLING DISTRICT (LOW <br />DENSITY) ¡ INCLUDING PROCEDURAL PROVISIONS AND PROVIDING FOR PENALTIES. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. Russell Smith stated he was the applicant in this Zoning Ordinance <br />and was present to answer any questions the Council might have. Mayor <br />Habingreither asked if anyone else wished to speak¡ no one did so, he <br />closed the public hearing. Mr. Mayhew moved for adoption of the Zoning <br />Ordinance and Mr. Taylor seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced a public hearing and adoption of a <br />Resolution, the caption which was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE FUTURE LAND USE PLAN OF THE CITY MASTER PLAN FROM OPEN <br />SPACE/FLOODWAY, COMMERCIAL, AND INDUSTRIAL TO COMMERCIAL AND <br />INDUSTRIAL AND OPEN SPACE/FLOODWAY FOR A 239 ACRE, MORE OR LESS, TRACT <br />OF PROPERTY LOCATED IN THE 2700 BLOCK OF IH-35 NORTH¡ AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. Steve Ramsey, Baker-Aicklen & Associates, stated he represents the <br />Perry Financial Corporation, the developer of this high quality project. <br />He also stated he is available to answer any questions the Council might <br />have. No one else wished to speak, so Mayor Habingreither closed the <br />public hearing. Ms. Narvaiz moved for adoption of the Resolution and Ms. <br />Tatum seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration an Ordinance on first <br />reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY'S 2002-2003 BUDGET TO TRANSFER FUNDING FROM THE <br />DAVIS LANE/AQUARENA SPRINGS DRIVE C.I.P. PROJECT TO A PARKLAND AND <br />RECREATIONAL FACILITIES ACCOUNT¡ REMOVING THE PARKLAND RESTRICTION ON <br />A PORTION OF THE OLD SEWER TREATMENT PLANT PROPERTY IN THE 1300 BLOCK <br />OF IH-35 NORTH¡ AND DECLARING AN EFECTIVE DATE. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading and Ms. <br />Narvaiz seconded the motion.
