<br />8. <br /> <br />Regular Meeting <br /> <br />November 25, 2002 <br /> <br />Page 8 <br /> <br />VEHICLE TO THE SAN MARCOS/HAYS COUNTY EMS, INC.¡ AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mayor Habingreither introduced for consideration Item 13 removed from the <br />consent agenda, adoption of an Ordinance on third and final reading, the <br />caption was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,448.06 ACRES, MORE <br />OR LESS, LOCATED OFF OF IH-35 NORTH, NORTH OF THE BLANCO RIVER, <br />INCLUDING THE CHAMPIONS CROSSING AND SADDLEBROOK SUBDIVISIONS (NORTH <br />IH-35 TRACT) ¡ APPROVING A SERVICE PLAN FOR THIS TRACT¡ INCLUDING <br />PROCEDURAL PROVISIONS¡ AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Ordinance on third and final <br />reading and Mr. Mayhew seconded the motion. Mr. Mayhew moved to table the <br />Ordinance to the Regular Meeting to be held on December 2, 2002 and Mr. <br />Mihalkanin seconded the motion, which passed unanimously. <br /> <br />Mayor Habingreither introduced for consideration Item 18 removed from the <br />consent agenda, adoption of a Resolution, the caption was read as follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY SAN MARCOS, TEXAS, <br />APPROVING THE CITY'S PARTICIPATION IN A MEMORANDUM OF AGREEMENT FOR <br />THE AUSTIN-SAN MARCOS MSA EARLY ACTION COMPACT¡ AND DECLARING AN <br />EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for adoption of the Resolution and Mr. Mihalkanin seconded <br />the motion. Mr. O'Leary stated EPA regulates air quality standards. EPA <br />is bringing heavy handed requirements in the future. Surrounding cities <br />are trying to put together voluntary wording with each area to come up with <br />their own standards to address. Bill Gill, Clean Air Force, stated the <br />Early Action Compact wants to improve air quality before the EPA does. He <br />stated five cities in the area have already approved this agreement. If a <br />plan is not submitted by April 15, 2003, then the EPA will designate this <br />as a non-attainment area and they will regulate starting April 15, 2004. <br />This EAC allows local communities to come up with their own plan and avoids <br />the stigma of being designated a non-attainment area. The Council then <br />voted unanimously for adoption of the Resolution. <br /> <br />Mayor Habingreither introduced for consideration approval of the placement <br />of Fire Fighter and Police Statues. Ms. Tatum moved for approval of the <br />placement of Fire Fighter and Police Statues, and Ms. Narvaiz seconded the <br />motion. Mr. Mihalkanin stated he has concerns with the lack of process for <br />bringing these statues to Council. He stated he is also concerned of <br />privatization of City property. He feels this should have first been <br />brought to the Arts Commission and/or Parks and Recreation Advisory Board <br />for approval. Ms. Tatum stated the Parks and Recreation Board has <br />discussed and seen the statues, and they are recommending the placement at <br />City Hall. Ms. Narvaiz stated the Council previously requested the Parks <br />
