SECTION 2. The temporary payment provisions in Section I of this ordinance may be <br />extended by subsequent ordinance of the City Council during the continuation of the current <br />declaration of a local state of disaster within San Marcos, Texas due to the COVID- 19 pandemic. <br />SECTION 3. Nothing in this ordinance shall be construed as a waiver of the obligation <br />of any person operating a food establishment in San Marcos to obtain a valid permit. All other <br />provisions of Chapter 18, Article 3 of the San Marcos City Code remain in full force and effect <br />and shall continue to apply to the operation of food establishments. <br />SECTION 4. If any word, phrase, clause, sentence, or paragraph of this ordinance is held <br />to be unconstitutional or invalid by a court of competent jurisdiction, the other provisions of this <br />ordinance will continue in force if they can be given effect without the invalid portion. <br />SECTION 5. All ordinances and resolution or parts of ordinances or resolutions in <br />conflict with this ordinance are repealed. <br />SECTION 6.
