<br />121. <br />Regular Meeting <br /> <br />October 14, 2002 <br /> <br />Page 8 <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN AGREEMENT BETWEEN THE CITY AND TURNER COLLIE & BRADEN, <br />INC. FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE IH 35/FAIRLAWN <br />21" WASTEWATER LINE PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE <br />THIS AGREEMENT ON BEHALF OF THE CITY; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for the adoption of the Resolution and Mr. Taylor seconded <br />the motion. Mr. Taylor inquired whether the $186,000 is for an engineering <br />service agreement. Ms. Anderson, Director of Engineering, stated the <br />Council has seen the City's CIP list, which has 38 projects worth $27 <br />million. She stated she currently has 3 Engineers who do in-house small <br />projects. This project is a $1.7 million project, which includes a <br />liftstation and force mains. Mayor Habingreither inquired whether the City <br />will act as the project manager. Ms. Anderson stated Turner Collie & <br />Braden, Inc. will complete the design work and construction inspections. <br />The Engineering Department will inspect the project to protect the City's <br />interest. The Council then voted unanimously for adoption of the <br />Resolution. <br /> <br />Mayor Habingreither introduced for consideration Item 24 removed from the <br />consent agenda, approval of Change Order No.1 for the Cottonwood Creek <br />Interceptor & Hwy. 123 Waterline Project. Ms. Narvaiz moved for approval <br />of Change Order No.1 and Mr. Mayhew seconded the motion. Mr. Mihalkanin <br />inquired when the City is bidding a project and the second low bid is a <br />local bidder, can the City select a local bidder. Mr. Mark Taylor stated <br />yes, the Council adopted a 3% policy, which means if the bids are within 3% <br />of each other, then the Council can choose a local bidder. Mr. Taylor <br />inquired as to the need for this Change Order. Ms. Anderson stated there <br />were existing utility conflicts along the waterline and wastewater line <br />which needed to be relocated at the City's expense. She stated these were <br />in direct conflict with the gravity line. The Council then voted <br />unanimously for approval of Change Order No.1 for the Cottonwood Creek <br />Interceptor & Hwy. 123 Waterline Project. <br /> <br />Mayor Habingreither introduced a discussion regarding the Solid Waste and <br />Recyclable Material Collection and Disposal Request for Proposals. Mr. <br />O'Leary stated he has given the Council a draft copy of the RFP for the <br />residential and recyclable materials. He stated he needs to know if the <br />Council would like residential colléction service twice a week or once a <br />week. Mr. O'Leary stated he has given the Council a summary of changes, <br />which were previously discussed by the Council. One of the changes is the <br />monetary penalties for complaints not resolved to the satisfaction of the <br />City Manager. He stated he also gave the Council a copy of the Service <br />Breakdown on Commercial Accounts along with advantages and disadvantages of <br />the City providing Commercial Solid Waste Collection Service. Mayor <br />Habingreither inquired what the Commercial customers were saying. Mr. <br />O'Leary stated the Commercial customers are concern with their cost. <br />Richard Mendoza, Director of Public Works, stated the commercial customers <br />he spoke with do not object as long as the price is right. He suggested <br />the City should allow this to be on a case-by-case basis if City's vendor <br />
