FOR PROFESSIONAL SERVICES IN CONNECTION WITH THE POST <br />ROAD PAVING AND DRAINAGE IMPROVEMENTS PROJECTS; AUTHORIZING THE CITY <br />MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND DECLARING <br />AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither introduced for consideration Item 14 removed from the <br />consent agenda, approval of an Ordinance on second reading, the caption <br />which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />AMENDING THE CITY'S ELECTRIC UTILITY RATE SCHEDULES TO REVISE ELECTRIC <br />UTILITY BILL PAYMENT DUE DATES AND PENALTY DATES, AND TO ADD NOISE, <br />NUISANCE DISCONNECT AND RECONNECT FEES; AND INCLUDING PROCEDURAL <br />PROVISIONS. <br /> <br />Mr. Mayhew moved for approval of the Ordinance on second reading and Ms. <br />Narvaiz seconded the motion. Mr. Taylor stated at the Regular Meeting held <br />October 14, 2002, the Council discussed changing the disconnect fee to be <br />$150 and reconnect fee to $20 during business hours. Mayor Habingreither <br />stated it takes five minutes to disconnect a meter. Mr. Mihalkanin stated <br />he has concerns with this Ordinance. He feels the disconnect fee should be <br />added cost time when done after hours, and during regular business hours <br />the reconnect should be $20. Mr. Taylor moved to amend $150 for the <br />disconnection for noise nuisance and $20 for the reconnection during normal <br />business hours, and Mr. Mihalkanin seconded the motion. Mr. Mark Taylor <br />suggested the Council charge based upon time of day if a reconnect is <br />requested after normal business hours as specified in the reconnect fee <br />schedule. Mr. Montoya inquired how many Utility employees are sent out to <br />reconnect services. Bob Higgs, Director of San Marcos Electric Utility <br />Department, stated when services are reconnected during business hours it <br />takes one employee, and after business hours one lineman and one technician <br />are sent out. Rodney Gonzales, Director of Finance, stated the policy <br />procedure on reconnecting services for noise nuisance is the violator first <br />goes to the Police Department. The police officer and supervisor verify <br />the party is over, and then the reconnection can occur. Mr. Mayhew asked <br />how many disconnections has the City done because of noise nuisance. Mr. <br />O'Leary stated the City has only done this one time. Mr. Taylor and Mr. <br />Mihalkanin withdrew their motion and second for amendment. Mr. Taylor then <br />moved to amend the Noise Nuisance Disconnect/Reconnect Charge to a Noise <br />Nuisance Disconnect at $150.00 and add Noise Nuisance Reconnect Charges to <br />be the same as other reconnect situations depending on the time of day, and <br />Mr. Mihalkanin seconded the motion. Mr. Montoya stated he feels the fees <br />should stay as they currently are, to make violators responsible for their <br />actions. On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Habingreither and Taylor. <br /> <br />NAY: <br /> <br />Montoya, Narvaiz, Mayhew and Tatum. <br /> <br />ABSTAIN: <br /> <br />None. <br />
