Mr. Mihalkanin inquired whether the <br />Council could adopt by September 30, 2002 to be in compliance with State <br />Law and then revisit the Ordinance and make modification. Mr. Mark Taylor <br />stated the Council does need to adopt on the third reading by September 30, <br />2002, and then the Council can revisit the Ordinance and make <br />modifications. Mr. Mihalkanin stated he would like to approve the <br />Ordinance as is and then hold two Public Hearings and revisit the Ordinance <br />after those hearings. Ms. Narvaiz inquired whether approved Master Plans <br />are exempted. Mr. Mark Taylor stated as the Ordinance is written now, <br />approved master plans are exempted, but developments in the pipeline would <br />have to pay the new rates. Mr. Taylor asked if homes already in the City <br />would be exempted. Mr. O'Leary stated the Ordinance only includes new <br />growth areas, but the Ordinance is not clear. Mr. Taylor stated he would <br />like the wording clarified. Mr. Mark Taylor stated Staff is still looking <br />at the cost of extending services to newly annexed areas and the City will <br />bear the costs. He also stated there could be other improvements such as a <br />lift stations, and Council may want to recover some costs. Mr. Mihalkanin <br />moved to amend the water and wastewater current charges and Ms. Narvaiz <br />seconded the motion. Mayor Habingreither stated he was not comfortable <br />with those figures. Ms. Narvaiz stated she would consider amending the <br />rate to the 1990 rate of $2,000.00. Mayor Habingreither agreed. Mr. <br />Mihalkanin and Ms. Narvaiz withdrew their motion for amendment. Mr. <br />Mihalkanin moved to amend Schedule 2 on Exhibit 6 to change the water and <br />wastewater impact fee to the 1990 rate of $2,000.00; $1,100.00 for water <br />and $900.00 for wastewater and Ms. Narvaiz seconded the motion, which <br />passed unanimously. Mr. Taylor made a motion to amend the Ordinance to <br />clarify the intent of no impact fee to be charged to existing residents, <br />Mr. Mihalkanin seconded the motion.
