<br />40. <br /> <br />Regular Meeting <br /> <br />September 9, 2002 <br /> <br />Page 7 <br /> <br />CITY MANAGER TO EXECUTE THIS AGREEMENT ON BEHALF OF THE CITY; AND <br />DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mayhew moved for adoption of the Resolution and Mr. Mihalkanin seconded <br />the motion. Ms. Narvaiz stated she needed a clarification of the diagram, <br />regarding two different shaded areas. She inquired if the sweeper would be <br />used in all the shaded areas. Ms. Franks, Director of Main Street, stated <br />the darker shaded area is the primary area, and the lighter shaded area is <br />the secondary area. Ms. Narvaiz inquired whether this agreement would work <br />for the downtown area. Ms. Franks stated she felt this would work well for <br />the downtown area. Mr. Taylor inquired whether the City had a driver with <br />a Commercial Driver's License, which would be able to operate the sweeper <br />if the City wanted additional sweeping. Mr. Cobb, the Director of Parks, <br />stated the City does have a CDL driver who can operate the sweeper if <br />needed. The Council then voted unanimously for adoption of the Resolution. <br /> <br />Mayor Habingreither introduced for consideration Item 20 removed from the <br />consent agenda, adoption of a Resolution, the caption which was read as <br />follows: <br /> <br />A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />APPROVING AN EXTENSION OF THE CITY'S WATER AND WASTEWATER SYSTEMS TO <br />SERVE THE PROPOSED COTTONWOOD CREEK DEVELOPMENT ADJACENT TO STATE <br />HIGHWAY 123; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mr. Mihalkanin moved for adoption of the Resolution and Mr. Taylor seconded <br />the motion. Mr. O'Leary stated the developer intends to develop a <br />residential development with some commercial areas for businesses. He also <br />stated the developer has requested permission to extend water and <br />wastewater for 458 acres located off Highway 123. This property is located <br />outside the city limits but within the ETJ and within the City's water <br />service area. Mr. O'Leary stated the request of the developer includes a <br />voluntary annexation. Mayor Habingreither inquired whether a liftstation <br />would be needed and who would be responsible for the expenses. Ms. <br />Anderson, Director of Engineering, stated presently a public liftstation is <br />being constructed in that area as part of the CIP. She also stated if <br />another liftstation is needed, the construction would be at the expense of <br />the developer, and would be subject to the City's oversize policy. Mr. <br />O'Leary stated all proposed oversize agreements come before the Council for <br />approval. Ms. Anderson stated she does anticipate the City will request an <br />oversize. The Council then voted unanimously for adoption of the <br />Resolution. <br /> <br />Mayor Habingreither introduced for consideration Item 21 removed from the <br />consent agenda, approval of sale of City-owned property in Green Haven <br />Estates Subdivision (between the homes at 226 and 304 Booth Drive). Mr. <br />Mayhew moved for the approval and Mr. Taylor seconded the motion. Ms. <br />Narvaiz inquired whether this approval was to get an appraisal. She also <br />stated she would like to see the appraisal value. Mr. Mark Taylor stated <br />this is a two step process. The first step is to see if the Council is in <br />
