City Council Meeting Minutes April 21, 2020 <br />MAIN MOTION: a motion was made by Council Member Baker, seconded by <br />Deputy Mayor Pro Tem Rockeymoore, to approve Ordinance 2020-18. Mayor <br />Hughson noted that all seven council members support cite and release in <br />general. <br />MOTION TO AMEND: a motion was made by Mayor Hughson, seconded by <br />Council Member Gonzales, to allow staff to change the ordinance to a <br />standard ordinance form. The motion carried by the following vote: <br />For: 6 - Council Member Derrick, Mayor Hughson, Mayor Pro Tem Mihalkanin, Deputy <br />Mayor Pro Tem Rockeymoore, Council Member Baker and Council Member <br />Gonzales <br />Against: 1 - Council Member Marquez <br />MOTION TO AMEND: a motion was made by Council Member Baker, <br />seconded by Mayor Pro Tem Mihalkanin, to add the direct citations from the <br />Texas Code of Criminal Procedures to the list of the following offenses and to <br />remove Class A under Driving while License Invalid. The section will now read: <br />Possession of Marijuana less than 4 oz, Class A or Class B misdemeanor, <br />Texas Health and Safety Code § 481.121(b)(1)&(2) <br />Driving while License Invalid, Class B misdemeanor, Texas Transportation <br />Code § 521.457 <br />Criminal Mischief, Class B misdemeanor, Texas Penal Code § 28.03(b)(2) <br />Graffiti, Class A or Class B misdemeanor, Texas Penal Code § 28.08(b)(2)&(3) <br />Theft of Property, Class B misdemeanor, Texas Penal Code § 31.03(e)(2)(A) <br />Theft of Services, Class B misdemeanor, Texas Penal Code § 31.04(e)(2) <br />The motion carried by the following vote: <br />For: 7 - Council Member Derrick, Mayor Hughson, Mayor Pro Tem Mihalkanin, Council <br />Member Marquez, Deputy Mayor Pro Tem Rockeymoore, Council Member Baker <br />and Council Member Gonzales <br />Against: 0 <br />MOTION TO AMEND: a motion was made by Council Member Baker, <br />seconded by Council Member Derrick, to amend the ordinance in recitals #4 <br />from 14.08 to 14.06. The section will now read: <br />114.
