<br />138. <br /> <br />Regular Meeting <br /> <br />July 22, 2002 <br /> <br />Page 3 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />ANNEXING TO THE CITY A TRACT OF LAND CONTAINING 1,448.06 ACRES, MORE <br />OR LESS, LOCATED OFF OF IH-35 NORTH, NORTH OF THE BLANCO RIVER, <br />INCLUDING THE CHAMPIONS CROSSING AND SADDLEBROOK SUBDIVISIONS (NORTH <br />IH-35 TRACT); APPROVING A SERVICE PLAN FOR THIS TRACT; INCLUDING <br />PROCEDURAL PROVISIONS; AND DECLARING AN EFFECTIVE DATE. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. No one wished to speak, so Mayor Habingreither closed the public <br />hearing. <br /> <br />Mayor Habingreither introduced for consideration a public hearing and <br />adoption of an Ordinance on emergency, the caption which was read as <br />follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS <br />INCREASING THE RATE FOR COLLECTION AND DISPOSAL OF RESIDENTIAL SOLID <br />WASTE AND RECYCLABLE MATERIALS; INCLUDING PROCEDURAL PROVISIONS; AND <br />DECLARING AN EMERGENCY. <br /> <br />Mayor Habingreither opened the public hearing and asked if anyone wished to <br />speak. 1) Dianne Wassenich stated she is a neighborhood representative and <br />feels the recycling services have made a tremendous difference in the <br />neighborhood cleanups. She stated she appreciated the Council inviting the <br />citizens to give input into the RFP process for solid waste collection. <br />She stated she feels many costs of service in the current contract with BFI <br />are being paid by single-family residential customers. 2) Tom Atkinson <br />stated he is with Green Guy Recycling, and that are willing to work on a <br />month-to-month temporary contract directly with the City until a contract <br />between Green Guy and the City can be worked out. No one else wished to <br />speak, so Mayor Habingreither closed the public hearing. Ms. Narvaiz moved <br />for adoption on emergency, and Mr. Mayhew seconded the motion. Mr. Mark <br />Taylor stated Section 4 needs to be amended to read "...this Ordinance will <br />take effect for all billings issued on or after September 1, 2002". Mr. <br />Mihalkanin stated he understood some of the monthly paYments from BFI to <br />Green Guy were not forthcoming. Mr. Mihalkanin requested BFI provide <br />Council with records showing all paYments pertaining to the subcontract, <br />which were made to Green Guy. Mr. Taylor inquired whether BFI would <br />continue to work with Green Guy. Mr. Mark Talbot, General Manager of BFI <br />Waste Services, stated BFI would work Green Guy throughout the extension <br />period. Mr. Mihalkanin moved to table this item until next Regular City <br />Council meeting held on August 12, 2002, and Ms. Tatum seconded the motion. <br />On roll call the following vote was recorded: <br /> <br />AYE: <br /> <br />Mihalkanin, Montoya, Mayhew and Tatum. <br /> <br />NAY: <br /> <br />Narvaiz, Habingreither and Taylor. <br /> <br />ABSTAIN: <br /> <br />None. <br />
