Mr. Mihalkanin stated he feels the Chair of the Planning and <br />Zoning Commission should be a resident of the City. Mr. Mihalkanin moved <br />to amend Option 1 to reflect the Chair of the Planning and Zoning <br />Commission must be a resident of the City of San Marcos, and Ms. Tatum <br />seconded the motion, which passed unanimously. The Council then voted <br />unanimously for adoption of the Ordinance on emergency. <br /> <br />Mayor Habingreither introduced for consideration approval of an Ordinance <br />on first reading, the caption which was read as follows: <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN MARCOS, TEXAS, <br />REVISING AND UPDATING CHAPTER 6, ANIMALS, OF THE CITY CODE; REVISING <br />CHAPTER 2, ADMINISTRATION, TO ESTABLISH A NEW ANIMAL SHELTER ADVISORY <br />COMMITTEE; INCLUDING PROCEDURAL PROVISIONS; AND PROVIDING FOR <br />PENALTIES. <br /> <br />Mr. Taylor moved for approval of the Ordinance on first reading, and Ms. <br />Narvaiz seconded the motion. Mayor Habingreither inquired whether Section <br />6.085 Minimum Standards of Care is responsible. Bert Stratemann, Animal <br />Services Manager, stated this section is the minimum standards of the Texas <br />Department of Health and Vernon's Statutes Chapter 169 for the City animal <br />control facility and for pet owners. Mr. Mihalkanin inquired whether the <br />revised Ordinance contained more than the Vernon's Health and Safety Code. <br />Mr. Strateman stated in areas of the Health and Safety Code, which were <br />unclear, the City's Ordinance clarified them better. Mr. Taylor requested <br />a copy of the State Statutes which pertain to the standard care before <br />second reading.
